May 22, 2012 <br />At a Regular Meeting of the City Council on Tuesday, May 22, 2012, there were <br />present: <br />Mayor Kenneth I. Wright, Vice Mayor Charles B. Whitehurst, Sr., William E. Moody, Jr., <br />Marlene W. Randall, Stephen E. Heretick, Paige D. Cherry, Dr. Curtis E. Edmonds, Sr., <br />City Manager Kenneth L. Chandler, City Attorney G. Timothy Oksman. <br />Reverend Larry Ugarte~ opened the meeting with prayer, which was followed by <br />the Pledge of Allegiance to the Flag. <br />Mayor Wright called the meeting to order and welcomed all in attendance. <br />Motion by Mr. Moody, and seconded by Mr. Whitehurst, to approve the minutes <br />of a Called Meeting of May 7, 2012, a Called Meeting of May 8, 2012, of a Regular <br />Meeting of May 8, 2012, and of a Called Meeting of May 15, 2012, and was adopted by <br />the following vote: <br />Ayes: Cherry, Edmonds, Heretick, Moody, Randall, Whitehurst, Wright <br />Nays: None <br />12 - 216 -Presentation: <br />• Presentation of special lapel pins to newly appointed board and commission <br />members. <br />- Unfinished Business - <br />12 - 183 -Use permit: <br />Motion by Ms. Randall, and seconded by Mr. Heretick, to adopt the following <br />resolution approved on first reading at the May 8, 2012 meeting, and was adopted by <br />the following vote: <br />12-183(A): <br />"RESOLUTION MODIFYING THE CONDITIONS OF AN EXISTING USE PERMIT FOR <br />BROAD STREET UNITED METHODIST CHURCH TO OPERATE A CHILD CARE <br />CENTER AT 300 BROAD STREET. <br />WHEREAS, the applicant, Broad Street United Methodist Church, was granted a <br />use permit on February 24, 2004 by the Council of the City of Portsmouth, Virginia to <br />operate a child care center subject to certain conditions; and <br />WHEREAS, the applicant has requested a modification of certain of the <br />conditions under which it is required to operate by the use permit; and <br />WHEREAS, the Planning Commission has recommended approval of the <br />modifications requested. <br />NOW THEREFORE BE IT RESOLVED by the Council of the City of Portsmouth, <br />Virginia that: <br />1. The application by Broad Street United Methodist Church (UP-12-03) to <br />modify certain of the conditions under which it is required to operate its child care <br />center is hereby granted. <br />2. The following modified conditions shall apply to the child care operation: <br />(a) The age range of the children shall be from newborn to 12 years of age. <br />(b) The facility shall be developed and operated in accordance with the submitted <br />floor and site plan, as revised to allow for the summer and after school programs. <br />
