389 <br /> <br />July 14, 1987 <br /> <br /> 87-308 Letter from the City Manager recommending adoption of <br />resolution authorizing the release of a sanitar) sewer easement <br /> the Gomley Chesed Cemetery. <br /> <br /> "On June 20, 1950, the City acquired a sanitary sewer easement <br />located in the Gomley Chesed Cemetery east of George Washington <br />Highway. <br /> <br /> Upon completion of the new 36" sewer, the existing gravit <br />sewer line through the cemetery has been abandoned and filled ~ith <br />concrete grout. <br /> <br /> Representatives from the Gomley Chesed congregation have <br />requested that the easement be released since it is no longer <br />necessary for public purposes. <br /> <br /> I recommend adoption of the resolutio~ authorizing the City <br />Manager to sign such Deed of Release." <br /> <br /> Motion of Mr. Simpson and seconded by Mr. Gray, the following <br />resolution was adopted, and by the following vote: <br /> <br />!~RESOLUTION AUTHORIZING THE CITY MANAGER TO RELEASE A <br />SEWER EASEMENT LOCATED IN THE GOMLEY CHESED CEMETERY <br />EAST OF GEORGE WASHINGTON HIGHWAY. <br /> <br /> WHEREAS, by deed dated June 20, 1950, recorded in Deed BdoR <br />215, page 519, in the Clerk's Office of the Circuit Court of the <br />City of Portsmouth, Virginia, the City acquired from the United <br />States of America a certain easement for sanitary sewer line locate, <br />in the Gomley Chesed Cemetery; and <br /> <br /> WHEREAS, said sewer line has subsequently been relocated and <br />the easement zs no longer required for public purposes. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the C6unail of the City of <br />Portsmouth, Virginia, that the City Manager be, and he hereby is, <br />authorized to sign a Deed of Release for that certain sanitary <br />sewer line easement described as follows: <br /> <br /> Beginning at sewer line station 48+20 on the <br />line between Gomley Chesed Congregation and Gate Street; <br />thence south 38o 46' west 227' to the approzimate center <br />line of the drainage ditch known as "Paradise Creek" on <br />the line between Gomley Chesed Congregation and property <br />now or formerly owned by Margaret A. Bulloch, sewer <br />station 50+47, said sewer line lying approximately 1S0' <br />southeasterly at right angles from and parallel to the <br />southeasterRy property line of U.S. Highway No. 17, <br />also known as "George Washington Highway", said <br />right-of-way running longitudinally across lots 41 <br />and 42 in the subdivision known as "Belport"; <br />length along center line of right-of-way 227'." <br /> <br />Ayes: Barnes, Corprew, Gray, Lucas, Simpson, Webb, Holle <br />Nays: None <br /> <br /> 87-309 - Letter from the City Manager recommending adoptien of <br />resolution to appoint ~iewers for the closing of Paul JonesAvenue <br />and two unnamed ten foot alleys on the north side of Craford Place. <br /> <br /> "Swimming Point Associates has made application to close Paul <br />Jones Avenue and two unnamed ten foot alleys on the north side of <br />Craford Place. The Notice of Application for appointment of viewer~ <br />has been advertised as required by law. <br /> <br /> I recommend adoption of the resolution appointing viewers <br />~ursuant to this application." <br /> <br /> <br />
