<br />a resolution authorizing the release of a utility easement in the
<br />portion of Sumlers lane north of London Boulevard.
<br />
<br /> "In December, 1979 City Council adopted an ordinance closing
<br />Sumlers Lane north of London Boulevard. At that time, certain
<br />utility services were located within the street right-of-way. The
<br />City retained an easemeKt for the ccntinued operation and mail
<br />of these utilities. Subsequently, the utilities have been relocate
<br />
<br /> Pertsmouth Redevelopment and Housing Authority has requested
<br />that the easement be released so that this property may be consoli-
<br />dated'with other paracels for marketing purposes.
<br />
<br /> I recommend adoption of the resolution authorizing the r
<br />of the easement in that portion of Sumlers Lane closed by o
<br />adopted by the City Council in 1979."

<br /> On motion of Mrs. Webb and seconded by Mrs. Lucas, the followi
<br />resolution was adopted, and by zhe follSwing vote:
<br />
<br /> "A RESOLUTION AUTHORIZING THE CITY MANAGER TO RELEASE
<br /> UTILITY EASEMENTS IN THE FCRMER SUMLERS LANE NORTH OF
<br /> LONDON BOULEVARD.
<br />
<br /> WHEREAS, by ordinance adopted by the Council of the City of
<br />Portsmouth, Virginia, on December 11, 1979, recorded in the Clerk'~
<br />Office of the Circuit Court of the City of Portsmouth, Virginia in
<br />Deed Boo~ 799, page 666, Sumlers Lane north of London Boulevard
<br />closed and vacated as a public street; and
<br />
<br /> WHEREAS, by said ordinance the City of Portsmouth, reserved
<br />unto itself an easemenT, right and privilege to install, maintain,
<br />operate and replace public utilities in said portion of the closed
<br />street; and
<br />
<br /> WHEREAS, said utilities have been relocated and the easement
<br />is no longer necessary for public purposes; and
<br /> WHEREAS, Portsmouth Redevelopment and Housing Authority has
<br />requested that said easement be released for the purpose of con-
<br />solidating said parcels for development purposes.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
<br />Portsmouth, Virginma, that the City Manager be, and he hereby is,
<br />authorized to sign a Deed of Release for the utility easement on
<br />the following described property:
<br />
<br /> All that certain piece or parcel of land, situated,
<br /> lying and being in the City of Portsmouth, Virginia,
<br /> known and designated as Sumlers Lane (Avenue) as shown
<br /> on that certain plat entitled "Plat Showing Survey of
<br /> Sumlers Lane to be Closed, Portsmouth Virginia", dated
<br /> July 13, 1979, prepared by Robert T. Addison and
<br /> Associates, Surveying and Engineering, a copy of which
<br /> is attached hereto."
