i02 <br /> <br />July 28, 1987 <br /> <br />"AN ORDINANCE TO APPROPRIATE $86,400 FROM THE CAPITAL <br />IMPROVEMENT FUND FOR MONITORING AND SPECIFICATION <br />WRITING UNDER PHASE I AND II OF THE CIVIC CENTER COMPLEX <br />~SBESTOS REMOVAL PROGRAM." <br /> <br /> 87-326 Letter from the City Manager recommending adoption <br />of an ordinance closing a portion of Churchland Boulevard; author- <br />izing the City Manager to convey property. <br /> <br /> "Churchland Shopping Center Associates has made application tc <br />vacate and close a portion of Chur~hland Boulevard adjacent to its <br />property. The viewers report and the report from the Planning <br />Commission recommend approval. <br /> <br /> In addition, it has been determined that the City owns the <br />underlying fee simple interest in this property. Pursuant to the <br />authority of Section 15.1-366, Code of Virginia, the City may sell <br />its interest to the abutting property owner provided the parties <br />agree as to the value of the property. The agreed value of the <br />subject property is $25,000.00, <br /> <br /> It is further recommended that the conveyance of the property <br />be conditioned such that Churchland Shopping Center Associates <br />shall agree to reconvey the property, or so much thereof as may be <br />necessary, for street improvements to Churchland Boulevard within <br />ten years from the date of the street closure..The reconveyance <br />would be for the same price, or proportionate share thereof. The <br />subject property would not be used by Churchland Shopping Center <br />Associates for any permanent construction or for calculating any <br />Code recuirements until such time ~s the final determination con~ <br />cerning improvements to Churchland Boulevard have been made. <br /> <br /> I recommend adoption of the ordinance closing this portion of <br />Churchland Boulevard and authorizing conveyance of the property to <br />Chm~chland Shopping Center Associates." <br /> <br /> Albert Taylor, &ttorney, P. O. Box 1475, Portsmouth, VA 23705 <br />representing Churchland Shopping Center, spoke in favor of the <br />ordinance. <br /> <br /> Arn¢ld Leon, Owner, P. O. Box 1475, Portsmouth, VA 23705, <br />spoke in favor of the street closing. <br /> <br /> On motion of Mr. Barnes and seconded by Mrs. Webb, the follo~ <br />ing ordinance was adopted on first and final reading, and by the <br />following vote: <br /> <br /> "AN ORDINANCE CLOSING A PORTION OF CHURCHLAND BOULEVARD" <br /> <br />Ayes: Barnes, Corprew, Gray, Lucas, Simpson, Webb, Holl~ <br />Nays: None <br /> <br /> 87-327 Letter from the City Manager recommending adoption o. <br />a resolution expressing the opposition of the Council of the City <br />of Portsmouth to the expansion or prologation of the use of Craney <br />Island as a disposal area. <br /> <br /> 'The Army Corps of Engineers is sponsoring a Public Scoping <br />meeting on August 6, 1987 at Churchland Junior High School to <br />obtain public comment on several alternative methods to dispose <br />of harbor dredge material. The attached announcement lists each <br />of the alternatives being considered. Proposals for Craney Island <br />include possible expansion to the north or west, or both. <br /> <br /> Expansion of the Craney Island disposal area, especially to <br />the west, would have a particularly negative effect on the River <br />Shore neighborhood, and would be unacceptable to the City of <br />Portsmouth.
