REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council." <br /> <br />Ayes: Cherry, Edmonds, Heretick, Moody, Whitehurst, Wright <br />Nays: None <br /> <br />- City Manager's Report - <br /> <br />12 - 43 - Adoption of an ordinance to amend Chapter 35 of the Code of the City <br />of Portsmouth, Virginia (2006) by amending Section 35-76 thereof to establish <br />April and Mayas hearing months for the Board of Equalization. Vision <br />Principles: Thriving Neighborhoods and a Sense of Community and Bold New <br />Directions. <br /> <br />Background: <br />. Paragraph A: The current City Code Section 35-76, Paragraph A states "There <br />shall be a Board of Equalization as provided in Section 2.12 of the Charter." The section <br />of the Charter that this paragraph refers to has previously been repealed and should <br />refer to the proper section of the Code of Virginia. <br />. Paragraph C: The current City Code Section 35-76, Paragraph C states, "The <br />Board of Equalization shall proceed to hold its hearings during the months of March and <br />April in each year and..." Assessment notices are prepared and mailed each year by <br />the end of February, with informal appeals being heard in March and Board hearings <br />scheduled beginning the end of March and running through the month of April. The <br />recently amended State Code section requires 45 days notice prior to hearing a <br />taxpayer's appeal. <br /> <br />Discussion: <br />. This ordinance would amend Section 35-76, Paragraph A of the City Code to <br />read, "There shall be a Board of Equalization as provided in Section 58.1-3370 of the <br />Code of Virginia." Further, this ordinance would amend Section 35-76, Paragraph C of <br />the City Code to read, "The members of the Board of Equalization shall proceed to hold <br />its hearings during the months of April and May in each year and..." This amendment <br />allows for the Office of the City Assessor to comply with the 45 day notice requirement <br />set forth in the amendment to State Code Section 58.1-3331, Paragraph E, effective on <br />January 12, 2012. <br /> <br />Financial Impact <br />. Adoption of an ordinance to amend Section 35-76, Paragraph A of the City Code <br />to read "There shall be a Board of Equalization as provided in Section 58.1-3370 of the <br />Code of Virginia, and to amend Paragraph C of the City Code to read "The Board of <br />Equalization shall proceed to hold its hearings during the months of April and May in <br />each year and... ... ... .."
