The section of the Charter that this paragraph refers to has previously been repealed and should refer to the proper section of the Code of Virginia. . Paragraph C: The current City Code Section 35-76, Paragraph C states, "The Board of Equalization shall proceed to hold its hearings during the months of March and April in each year and..." Assessment notices are prepared and mailed each year by the end of February, with informal appeals being heard in March and Board hearings scheduled beginning the end of March and running through the month of April. The recently amended State Code section requires 45 days notice prior to hearing a taxpayer's appeal. Discussion: . This ordinance would amend Section 35-76, Paragraph A of the City Code to read, "There shall be a Board of Equalization as provided in Section 58.1-3370 of the Code of Virginia." Further, this ordinance would amend Section 35-76, Paragraph C of the City Code to read, "The members of the Board of Equalization shall proceed to hold its hearings during the months of April and May in each year and..." This amendment allows for the Office of the City Assessor to comply with the 45 day notice requirement set forth in the amendment to State Code Section 58.1-3331, Paragraph E, effective on January 12, 2012.
