<br />January 24. 2012 <br /> <br />d. A silt fence shall be installed between the land disturbance and the water's edge <br />until all construction is completed. <br /> <br />e. The applicant shall go through the site plan review process and receive all <br />required permits, including but not limited to the following: storm water, erosion and <br />sediment control, and land disturbance. <br /> <br />f. Permits must be obtained before land disturbance can begin. <br /> <br />g. A Landscaping Plan must be approved that provides the area will be landscaped <br />in a manner acceptable to the Director of Planning. <br /> <br />h. The 50 foot seaward portion of the Resource Protection Area shall be staked and <br />fenced in a way to prevent the location of any equipment or materials in the area during <br />construction. <br /> <br />i. The establishment shall operate generally in accordance with the approved site <br />layout and floor plans dated July 6, 2011. Minor changes may be approved by the <br />Director of Planning. <br /> <br />j. The occupant load of the facility shall not exceed 337 persons, including staff and <br />patrons, at any time or as required by the Building Official. <br /> <br />k. Days and hours of operation shall be daily no earlier than 8:00 a.m. to no later <br />than 12:00 midnight, 7 days a week <br /> <br />I. The applicant shall maintain 26 parking spaces for the establishment on site and <br />provide a valet plan complete with a contract of the use of nearby parking lots. <br /> <br />m. The establishment shall not include any outdoor operations after 9 P.M. <br /> <br />n. The owner/operator shall ensure that noise is not audible at the property line. <br /> <br />o. The owner/operator shall provide when events involve the service of alcoholic <br />beverages security. Security shall be provided by individuals who are certified by the <br />Virginia Department of Criminal Justice Services. <br /> <br />p. The owner/operator shall obtain an approved plan for trash removal from the <br />Department of General Services. <br /> <br />q. The owner/operator must obtain and keep current any required operating <br />licenses and shall operate in accordance with federal, state and local regulations. <br /> <br />r. The owner/developer shall be responsible for upgrades to water and sewer, as <br />necessary, including the installation of a backflow preventer device approved by the <br />Public Utilities Department. <br /> <br />s. All taxes in connection with the proposed use shall be paid when due. <br /> <br />t. The owners and/or operators of the establishment shall not violate any laws of <br />the Commonwealth or ordinances of the City related to peace and good order, not suffer <br />repeated or chronic violations by any of its patrons or customers. If the Chief of Police, <br />in his discretion, determines that there are significant violations of this type to comprise <br />a significant law enforcement problem, he shall so notify the applicant in writing and <br />shall provide a copy of such notice to the Director of Planning. If, within six months of <br />the date of such letter, the Director of Planning determines that the offenses against <br />peace and good order are continuing, then he may initiate proceedings for the <br />revocation of this permit. Provided, however, that if at any time problems exist of such a <br />severity that the Chief of Police determines that there is a significant risk to public safety <br />or peace and good order of such proportions as to create a risk of blight, revocation <br />proceedings may be initiated by the Director of Planning regardless of the six month <br />requirement. <br />
