<br />January 10. 2012 <br /> <br />(d) Is configured to minimize adverse effects, including the visual impacts of the <br />proposed use on adjacent lands; <br /> <br />(e) Avoids significant deterioration of water and air resources, and other natural <br />resources; <br /> <br />(f) Maintains safe and adequate egress and ingress onto the site and safe road <br />conditions around the site; <br /> <br />(g) Allows for the protection of property values and the ability of neighboring lands to <br />develop the uses permitted in their zoning district(s); <br /> <br />(h) Complies with all other city, state, and federal laws and regulations. <br /> <br />2. That High Meadows Holdings, LLC, is hereby granted a use permit pursuant <br />to Section 40.1-2.3B of the Code of the City of Portsmouth, Virginia (2006) for the <br />operation of a child care center at 915 High Street, and being more particularly <br />described as: <br /> <br />UP-11-05 <br /> <br />915 High Street <br /> <br />Beginning at a point 117':t from the southwest comer of High and Chestnut Streets; <br />thence, in a westerly direction 60':t to a point; thence, in a southerly direction 226':t to a <br />point; thence, in an easterly direction 60':t: to a point; thence, in a northerly direction <br />226':t: to a point of the beginning. <br /> <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) The occupant load of the facility shall not exceed 100 children at any time as <br />required by the Building Official. <br /> <br />(b) The hours of operation shall be no earlier than 6:30 a.m. to no later than 6:30 <br />p.m. The outdoor playground shall be limited to use only during the hours of 8:00 a.m. <br />and 6:00 p.m. <br /> <br />(c) Prior to issuance of any building permits a complete set of building plans and <br />specifications for all improvements shall be submitted and approved by the City, and in <br />particular: <br /> <br />(1) All interior improvements and the playground area shall comply with all <br />requirements determined to be applicable by the Building Official and the Fire Marshall's <br />Office. <br /> <br />(2) No loading and unloading of children shall occur on High Street. All loading and <br />unloading shall occur from the parking lot to the rear of the building. The Applicant shall <br />provide seven offsite parking spaces for staff in accordance with City regulations and <br />ordinances. Proof of such spaces shall be provided to the Planning Director. The <br />Planning Director shall also approve the playground area and any other modifications to <br />the site layout required by the Child Day Care Center. <br /> <br />(3) The applicant shall obtain approval from the Downtown Design Committee (DDC) <br />for any exterior alterations, including signage and the playground area. <br /> <br />(4) Applicant shall provide street frontage parking lot landscaping along King Street <br />in accordance with the requirements of City Ordinances. <br /> <br />(d) The applicant must obtain and keep current any required operating licenses and <br />shall operate in accordance with federal, state and local regulations. <br /> <br />(e) All taxes and fees in connection with the proposed use shall be paid when due. <br />
