<br />Januarv 10. 2012 <br /> <br />(b) S-11-02 <br /> <br />PORT NORFOLK - Ordinance granting the request of Attorney <br />Eugene White for the closure of a portion of a 15 foot wide alley <br />east of Douglas Avenue. The subject alley is further described as <br />being located 140 feet more or less west of the southwest corner of <br />the intersection Douglas Avenue and Detroit Street. The proposed <br />section to be closed begins 120 feet south of the southern line of <br />Detroit Avenue and continues southwardly to its terminus. Vision <br />Principle: Bold New Directions. <br /> <br />1. Margaret Windley, 443 Douglas Avenue, spoke in opposition to this item. <br /> <br />2. Erica Nestler, 413 Douglas Avenue, spoke in opposition to this item. <br /> <br />3. John Lifsey, 229 Mount Vernon, spoke in opposition to this item. <br /> <br />4. Tony Goodwin, 38 Linden Avenue, spoke in support of this item. <br /> <br />Motion by Mr. Moody, and seconded by Mr. Whitehurst, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />"ORDINANCE TO CLOSE A PORTION OF A 15' WIDE ALLEY EAST OF DOUGLAS <br />AVENUE." <br /> <br />Ayes: Cherry, Edmonds, Heretick, Moody, Whitehurst, Wright <br />Nays: None <br /> <br />- Unfinished Business- <br /> <br />11 - 475 - Use permit: <br /> <br />Motion by Mr. Whitehurst, and seconded by Mr. Edmonds, to adopt the following <br />resolution approved on first reading at the December 13, 2011 meeting, and was <br />adopted by the following vote: <br /> <br />11-475: <br /> <br />"RESOLUTION GRANTING A USE PERMIT TO HIGH MEADOWS HOLDINGS, LLC, <br />TO OPERATE A CHILD DAY CARE CENTER AT 915 HIGH STREET. <br /> <br />WHEREAS, High Meadows Holdings, LLC, has made application pursuant to <br />Section 40.1-2.3B of the Code of the City of Portsmouth, Virginia (2006) for the granting <br />of a use permit for the operation of a child care center at 915 High Street, Portsmouth, <br />Virginia; and <br /> <br />WHEREAS, the applicant and the Planning Director have done all things <br />required to be done in connection with said application; and <br /> <br />WHEREAS, the Planning Commission has recommended the granting of the <br />application for a use permit with conditions. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1. That it finds that the use for which the permit is sought: <br /> <br />(a) Complies with the applicable standards of the Zoning Ordinance; <br /> <br />(b) Is consistent with the comprehensive plan; <br /> <br />(c) Is compatible with the character of surrounding lands and the uses permitted in <br />the subject property's zoning district; <br />
