Januarv 10. 2012 (b) S-11-02 PORT NORFOLK - Ordinance granting the request of Attorney Eugene White for the closure of a portion of a 15 foot wide alley east of Douglas Avenue. The subject alley is further described as being located 140 feet more or less west of the southwest corner of the intersection Douglas Avenue and Detroit Street. The proposed section to be closed begins 120 feet south of the southern line of Detroit Avenue and continues southwardly to its terminus. Vision Principle: Bold New Directions. 1. Margaret Windley, 443 Douglas Avenue, spoke in opposition to this item. 2. Erica Nestler, 413 Douglas Avenue, spoke in opposition to this item. 3. John Lifsey, 229 Mount Vernon, spoke in opposition to this item. 4. Tony Goodwin, 38 Linden Avenue, spoke in support of this item. Motion by Mr. Moody, and seconded by Mr. Whitehurst, to adopt the following ordinance, and was adopted by the following vote: "ORDINANCE TO CLOSE A PORTION OF A 15' WIDE ALLEY EAST OF DOUGLAS AVENUE." Ayes: Cherry, Edmonds, Heretick, Moody, Whitehurst, Wright Nays: None - Unfinished Business- 11 - 475 - Use permit: Motion by Mr. Whitehurst, and seconded by Mr. Edmonds, to adopt the following resolution approved on first reading at the December 13, 2011 meeting, and was adopted by the following vote: 11-475: "RESOLUTION GRANTING A USE PERMIT TO HIGH MEADOWS HOLDINGS, LLC, TO OPERATE A CHILD DAY CARE CENTER AT 915 HIGH STREET. WHEREAS, High Meadows Holdings, LLC, has made application pursuant to Section 40.1-2.3B of the Code of the City of Portsmouth, Virginia (2006) for the granting of a use permit for the operation of a child care center at 915 High Street, Portsmouth, Virginia; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of the application for a use permit with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That it finds that the use for which the permit is sought: (a) Complies with the applicable standards of the Zoning Ordinance; (b) Is consistent with the comprehensive plan; (c) Is compatible with the character of surrounding lands and the uses permitted in the subject property's zoning district;
