<br />December 13. 2011 <br /> <br />- City Manager's Report - <br /> <br />11 - 476 - Adoption of a resolution authorizing the City Manager to execute a <br />permit to allow the United States Navy to construct a water line under and <br />across Elm Avenue to service Scott Center. Vision Principle: Bold New <br />Directions. <br /> <br />Background: <br />. The Navy has done improvements in the Scott Center area for sometime, and <br />there is a necessity to provide more water supply to these facilities. <br /> <br />Discussion: <br />. The Navy will be responsible to bear all costs of the construction of the water line <br />and of replacing the street to its original condition after completion. <br />. The City's permit will contain provisions related to the maintenance of the line, <br />and its removal in the instance use of the road should ever require it. <br />. This water line is part of the ongoing effort to upgrade Scott Center. <br /> <br />Financial Impact: <br />. None for the City. <br /> <br />Recommended Action: <br />. Adoption of a resolution authorizing the City Manager to execute a Permit and <br />any other necessary documents providing the Navy with the authority to construct a <br />water line under and across Elm Avenue. Vision Principle: Bold New Directions. <br /> <br />Next Steps following City Council Action: <br />. The City Manager will execute the Permit and other required documents on <br />behalf of the City. <br />. The Office of the City Attorney will see to the proper recordation of said Permit. <br /> <br />Motion by Mr. Edmonds, and seconded by Mr. Heretick, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />"RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A PERMIT TO <br />ALLOW THE UNITED STATES NAVY TO CONSTRUCT A WATER LINE UNDER <br />AND ACROSS ELM AVENUE TO SERVICE SCOTT CENTER. <br /> <br />BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the <br />City Manager be, and he hereby is authorized to execute a permit and any other <br />documents necessary allowing the Navy to construct, operate, repair and maintain a <br />water line under and across Elm Avenue within a fifteen (15') foot corridor as defined by <br />a Plat to be filed and recorded with said permit, under such terms and conditions as he <br />shall deem to be in the best interest of the City of Portsmouth." <br /> <br />Ayes: Cherry, Edmonds, Heretick, Moody, Whitehurst, Wright <br />Nays: None <br /> <br />11 - 477 - Adoption of a resolution amending the rules of order and procedure of <br />the Portsmouth City Council. Vision Principle: Bold New Directions. <br /> <br />Background: <br />. City Council meetings are conducted under rules adopted by Council. From time <br />to time, Council amends these rules to improve the conduct of meetings, and to better <br />serve the citizens. The rules were last amended on October 28, 2008. <br /> <br />Discussion: <br />. The only change to the rules is as follows: <br />Change seating order of Council Members. <br />
