i86 October 27, 1987 Gail Tiesenga, 375 Middle Street, representing Olde To, ne Civic League, spoke in opposition to the project and requested a meeting with the applicant before final approval off the pro3ect. Motion of Mrs. Webb and seconded by Mr. Barnes, to defer GNP 87-12 as requested by the applicant to the regular meeting of November 24, 1987, and was adopted by unanimous vote. Other Items Under Unfinished Business: 87-441 Use permit application: (a) Resolution granting a use permit to Kenneth W. Tomosovich, Owner, by Louis C. Bell, III, for a junkyard and salvage business at 800 Peninsula Avenue, approved on first reading at the Public Hearing of October 13, 1987, was taken up and read. Louise C. Bell, III, 801Gatefield Lane, Chesapeake, was available to answer any questions. On motion of Mrs. Lucas, and seconded by Mr. Corprew, the following resolution was adopted on final reading and by the following vote: "A RESOLUTION GRANTING A USE PERMIT TO LOUIS C. BELL, III TO OPERATE A JUNKYARD AT 800 PENINSULA AVENUE. WHEREAS, Kenneth W. Tomosovich, owner, by Louis C. Bell, III has made application pursuant to ~40-69 (b) of the Code of the City of Portsmouth, Virginia, as amended, for the granting of a use permit as hereinafter-described; and WHEREAS, the applicant and the Planning all things required to be done in connection application; and Director have done with said WHEREAS, the Planning Commission has recommended the granting of said use permit, with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the use permit is sought: (a) Will not affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or injurious to the property and improvements in the neighborhood; and (c) will be in accord ~ith the purposes of th~ Zoning Chapter of the City Code. 2. Louis C. Bell, III is hereby granted a use permi!t pursuant to ~40-69 (b) of the Code of the City of Portsmouth, Virginia, to operate a junkyard as that term is defined therein at 800 Peninsula Avenue, such parcel being more particularly described as Tax Map 188, Parcel 1 (UP-87-20).
