499 November 10, 1987 (f) Use Permit UP 87-23 - CHURCHLAND NEIGHBORHOOD: Use permit application of West Norfolk Associates, by Agent, Richard K. Stell, for child day care center at 3907 Cedar Lane. V. Thomas Forehand, Jr., 109 wimbledom Square, Chesapeake, attorney, representing West Norfolk Associates/LaPetite Academy, inCo, spoke in support of the application. Motion of Mr. Simpson and seconded by Mr. Gray, to concur the recommendation of the Planning Commission, UP 87-23 for a child care center at 3907 Cedar Lane, was approved on first reading and was adopted by unanimous vote. (g) CA 87-16 CODE AMENDMENT: A proposal to amend Section 40-121 of the City Code pertaining to permitted uses in the Downtown D=l~'District. Motion of Mr. Barnes and seconded by Mr. Simpson, to concur in the~:ad~pt~on of CA-87-16 to amend Section 40-121 of the City Code~p~rta~ning to pe~mit~ed u~es--in the Downtown. D~ District, was approved on first,reading, and was adopted~bY uDanimous vote. - REPORTS FROM THE CITY MANAGER - 87-474 - Letter from the City Manager recommending adop- tion of a resolution appointing viewers for the closure of a portion of First'Street. "The City of Portsmouth has made application to vacate a portion of First Street. The-Notice of Application and Request for Appoiutment of Viewers has been advertised, I recommend adoption of the resolution appointing viewers for this application." Motion of Mrs. Lucas and seconded by Mr. GTay, the following resol'ution was adopted, and by the following vote: "A RESOLUTION APPOINTING VIEWERS FOR THE CLOSURE OE A PORTION OF FIRST STREET. WHEREAS, the City of Portsmouth 'has made application to vaca~t~,~c~los~'and discontinue ~he hereinafter descri'bed portion of FirSt~eet-~nd i~ appeafin~ that ~M~tice of ADp~¢-ation and Request for Appointment of Viewers has been duly ad~e~-r~ised as required by law.
