Novembe~ 24, 1R87 ~_ <br /> <br /> Motion of Mrs. Webb and seconded by Mr. Gray, the <br />following 'res~olution was adopte-d~, and by the fo~llowing voice: <br /> <br /> "~ 'RESOLUTION ENDORSING THE ESTABL~ISHMENT OF'~AN~'' <br /> INDEPENDENT POLICY BOARD, FOR THE SOUTHEASTERN VIRGINIA <br /> ALCOHOL SAFETY ACTION PROGRAM. <br /> <br /> WHEREAS, 'th'e Com~conwealt of Virg~inia in the ~interest of <br />highway' safety ha~ provided by law pro~r~s for ~roba~n, <br />education and rehabilitation of persons char~ed with driyin~ <br />motor vehicles ~;~ ~e in~l-ue~ce~ -of :~lcoho~lTM be~ra~es~ a~ <br />other self~'a~mi'~i~ed~ d~ugs'., S~Ck ~o~ams- <br /> <br /> ~EREAS, the Southeastern Virginia <br />Program was established on July 1, 1975 for the purpose of <br /> <br />ordina.~ces ad6p ~ ~i ~ ca cc~r~da ~' ~t~e ~ewi~h~f~nd <br /> <br /> WHEREAS, the ~ppl~icable previsions of ~he Code of Virginia <br />requires the establishment~of a VASAP Commission and that' <br />Commission establish procedures for the operation of local <br />Alcohol'Safe't'~/~c'ti6n.~rograms; and <br /> <br /> WHEREAS, ~he.VA~P Commission in its meeting on,~pril 3, <br />1987, issued directives that all localiVASAP Programs would <br />immediately establish and implement an independent Policy Board <br />Represefi~ativS of ~l'I localities served by the Program tO <br />operate the Program; and <br /> <br /> WHEREAS, by resolution of the Council of the City of <br />Portsmouth, Virginia, the City of Portsmouth became part of the <br />Southeastern Virginia Alcohol Safety Action Program pursuant to <br />~15.1-21 of the Code of VirginIa. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED that the Council of the <br />City of Portsm~ut'~ Vi~gin'ia, e~dorses~the~ ~stablis~me~t~of an <br />Independent Polfd~ Bdard for the ;Sout'he~sCern ·VASAP"and ~bat': <br /> <br /> 1. The~B~s~h~I1 consist ~Of~'fift~e~ (15)' memb~rs, J O~ne'~ <br />person appointed'by the governing body'of each 'participabing, <br />jurisdiction for a term of at least two (2) years; <br /> <br /> 2. The~'~tafie~f the Bo~d',gh~l.b~ Se~ected~by~ma~o,ri~y <br />vote of appoint~$:~mbers to serv~ubeD~s cliche (t) year~each~ <br />and shall i~clud~ p~sons representing!ed~cation,'potice, '- ~ <br />courts and citizens; <br /> <br /> 3. The Program shall be operated by the Policy Board in <br />compliance with the Commission policies and procedures and <br />local mandates; , ~ ~ <br /> <br /> 4. The Executive Director shall prepare and submit for <br />approval to the Policy Board for each fiscal year of budget ~o <br />include client fees and any other available funds as deemed <br />appropriate by the Board, but will include no costs to the <br />participating jurisdictions. The Commission on VASAP' shall be <br />responsible for funding any deficit occurring in the operation <br />of ~he SOutheastern VASAP Program. <br /> <br /> 5. Participating cities or counties may withdraw at any <br />time by official action of the governing body and appropriate <br />notice to the Policy Board.
