A copy of City Council's resolution will be sent to Virginia Office of EMS and to <br />Eagle Medical Transports, LLC for inclusion in their application for EMS Agency <br />License. <br /> <br />Motion by Mr. Whitehurst, and seconded by Mr. Moody, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />"RESOLUTION GRANTING APPROVAL FOR EAGLE MEDICAL TRANSPORTS, <br />LLC, A PRIVATE EMERGENCY MEDICAL SERVICES AGENCY, TO PROVIDE <br />CERTAIN TRANSPORT SERVICES WITHIN THE CITY OF PORTSMOUTH. <br /> <br />WHEREAS, Section 15.2-955 of the Code of Virginia provides that no <br />organization shall provide emergency medical services (EMS) without the prior approval <br />by resolution of the local governing body; and <br /> <br />WHEREAS, Virginia Administrative Code regulations, specifically 12 VAC 5-31- <br />420, also require that an EMS agency receive an ordinance or resolution from the <br />governing body of each locality where the agency maintains an office or stations an <br />EMS vehicle for response within a locality; and <br /> <br />WHEREAS, Eagle Medical Transports, LLC ("Eagle"), desires a resolution <br />supporting a state license to provide certain medical transport services in the City of <br />Portsmouth, Virginia. <br /> <br />NOW THEREFORE, BE IT RESOLVED, by the Council of the City of <br />Portsmouth, Virginia, that: <br /> <br />1. Eagle Medical Transports, LLC, is hereby granted approval to provide <br />certain medical transport services within the City of Portsmouth, Virginia and to obtain <br />agency license approval from the Virginia Office of Emergency Medical Services in <br />accordance with the following requirements which shall apply when Eagle is providing <br />services within the City of Portsmouth: <br /> <br />(a) Eagle shall limit its transport services to nonemergency transports when <br />operating in the City of Portsmouth. <br /> <br />(b) Eagle shall not attempt to provide service to, nor shall it respond to, emergency <br />situations (commonly known as "911 Calls") within the City unless requested by an <br />authorized official of the Portsmouth Department of Fire, Rescue, and Emergency <br />Services or through a written agreement with the City. <br /> <br />(c) Eagle must immediately report any emergency situation that it encounters in the <br />normal course of its transport business within the City of Portsmouth to the dispatch <br />center to be handled by the Department of Fire, Rescue, and Emergency Services. <br /> <br />(d) Eagle must comply with all applicable federal, state and local laws and <br />regulations, maintain a valid Virginia Department of Health Office of Emergency Medical <br />Services license and a valid business license, pay all federal, state and local taxes, and <br />keep its transport vehicles and medical equipment in a safe, neat, well-maintained and <br />sanitary condition. <br /> <br />2. The Fire Chief is hereby authorized by City Council to enforce the terms of <br />this resolution. If the Fire Chief determines that there has been a material violation of <br />any provision hereof, or any other conduct that places public safety or the public interest <br />at risk, he shall report it to the Virginia Office of Emergency Medical Services and shall <br />thereafter cooperate with said Office in any investigation. <br />
