<br />September 13. 2011 <br /> <br />Discussion: <br />. This Investment consists of one IED/WMD/CBRNE Detection and Response <br />vehicle equipped with state of the art, mission centric, supporting tools and assets as a <br />proven platform for responding to explosives events and for vessel assaults. <br />. This investment provides the mission critical platform and devices that facilitate a <br />unified regional response that improves local agencies' abilities to provide port security, <br />emergent threat deterrence, watercraft intention assessment and critical incident <br />response. It will enhance the abilities of the Norfolk Harbor's law enforcement agencies <br />to perform the identification, detection and neutralizing of improvised explosive devices <br />and to effect rescue operations. <br /> <br />Financial Impact: <br />. This grant requires a 25% cash match of $60,622 by the City of Portsmouth, <br />which will be provided from the Asset Forfeiture/Police State Seizures account in the FY <br />2011-2012 Donations Fund. <br /> <br />Staff Recommends: <br />. Adoption of an ordinance to appropriate a $242,490 grant from the U. S. <br />Department of Homeland Security through the Virginia Department of Emergency <br />Management to the Portsmouth Police Department to provide funds for acquisition of <br />equipment for Portsmouth Police Department. Vision Principles: World Class Maritime <br />Center, and Bold New Directions. <br /> <br />Next Steps Following Council Action: <br />. The Chief of Police or his designee will provide grant management and oversight. <br /> <br />Motion by Mr. Edmonds, and seconded by Mr. Heretick, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />"ORDINANCE ACCEPTING A GRANT IN THE AMOUNT OF $181,868 FROM <br />THE U.S. DEPARTMENT OF HOMELAND SECURITY THROUGH THE VIRGINIA <br />DEPARTMENT OF EMERGENCY MANAGEMENT AND APPROPRIATING A TOTAL <br />SUM OF $242,490 IN THE FY 2011-12 GRANTS FUND FOR THE PURCHASE OF <br />EQUIPMENT TO PERFORM IDENTIFICATION, DETECTION AND NEUTRALIZING <br />OF IMPROVISED EXPLOSIVE DEVICES AND TO EFFECT RESCUE OPERATIONS <br />RELATED TO PORT SECURITY." <br /> <br />Ayes: Cherry, Edmonds, Heretick, Moody, Randall, Whitehurst, Wright <br />Nays: None <br /> <br />11 - 379 - Adoption of an ordinance to amend Chapter 12 of the Code of the City <br />of Portsmouth, Virginia (2006) by adding a new Division 7 thereto entitled <br />"Debarment" containing new Sections 12-291 through 12-295, to establish <br />debarment procedures within the City's public procurement process. Vision <br />Principle: Bold New Directions. <br /> <br />Background: <br />. "Debarment" is a process by which a contractor is disqualified from bidding on <br />any city contracts. State law authorizes localities to enact debarment procedures. <br />Portsmouth has never done so. <br /> <br />Discussion: <br />. The ordinance would allow (but not require) the Purchasing Agent to debar a <br />contractor that engages in unprofessional or improper conduct. <br />. A specific procedure must be followed to debar. It requires concurrence of the <br />City Manager or his designee and approval for form and legality by the City Attorney or <br />his designee. <br />. Debarment may be for whatever period of time is commensurate with the <br />misconduct. <br />. If a contractor has not performed properly, but short of meriting immediate <br />debarment, the contractor may be put on terms to ensure better future performance, on <br />pain of debarment. <br />
