March 22, 1988 <br /> <br /> "A RESOLUTION APPOINTING VIEWERS FOR CLOSING A PORTION OF <br /> AVONDALE ROAD. <br /> <br /> WHEREAS, Calvary Evangelical Baptist Church has made <br />application to vacate, close and discontinue the <br />hereinafter-described portion of Avondale Road, and it <br />appearing that Notice of Applicatio~ and Request for <br />Appointment of Viewers has been advertised.~s required~by, law. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia, that Richard D. Ottavio, Waldo Uavis, <br />william~Choat~, James Griffin, and James~Linehan be appointed <br />viewers and ~that George Powers, Sr., and H~oward Davis be <br />appointed alternate vlewers in the event one of the p~eceding <br />viewers fails to participatet said viewers to view the <br />hereinafter-described portion of such street and to report to <br />this Council in writinq whether in their oplnlon any~ and if <br />any what, inconvenience would result in vacating and closing <br />the following: <br /> <br /> Ail that certain strip of land, situate~in the <br />City of Portsmouth, Virginia and being that portion <br />of Avondale Road as shown on the plat of victory <br />Park, Section One, duly recorded in the Clerk's <br />Office of the Circuit Court of the City of <br />Chesapeake in Map Book 35, page 94, as follows, <br />to-wit: Beginning at a point on the western side of <br />Avondale Road at the southeastern corner of Lot 101 <br />as shown on the plat of Victory Park, Section One, <br />duly recorded in the Clerk's Office of the Circuit <br />Court of the ~City of Chesapeake in Map Book 35, page <br />94 and from thence running along the western side of <br />Avondale Road, S 43' 52' 10" E .24t.74 'feet to a~ <br />point; thence in an easterly direction in a straight <br />line to a point on the eastern side of Avondale. Road <br />at the southwestern corner of the property belonging <br />to Calvery Evangelical Baptist Church; and from <br />thence running N 43- 52' 10" W along the ~eastern <br />side of Avondale Road 266.32 feet to the <br />southwestern corner of Lot 107 as shown o~ the plat <br />of Victory Park, Section One; thence in a westerly <br />direction in a straight line to the~goutheaStern <br />corner of Lot 101 as shown on the plat of Victory <br />Park, Section One, the point of~beginning. <br /> <br /> 88-124 Letter from the City Manager recommending <br />adoption of a resolution requesting the virginia Department of <br />Transportation to approve certain additions and deletions of <br />streets in the City of Portsmouth for the purpose of <br />calculating maintenance payments. <br /> <br /> "Each year the City of Portsmouth submits to the Virginia <br />Department of Transportation a list of additions, deletions, <br />and changes to the streets eligible for maintenance pa!hnents <br />under the State Functional Classification System as set forth <br />in Section 33.1-41.1 of the Code. These roadway sections are <br />located primarily in new subdivisions where the streets were <br />recently completed by the developers. <br /> <br /> A requirement by VDOT is that these lists be accompanied <br />by a City Council resolution.
