<br />July 12. 2011 <br /> <br />11 - 280 - Adoption of an ordinance repealing Chapter 15 of the Code of the City <br />of Portsmouth, Virginia (2006) and adopting a new Chapter 15.1 pertaining to food <br />and food establishments. Vision Principles: Bold New Directions and Thriving <br />Neighborhoods and a Sense of Community. <br /> <br />Background: <br />. The Portsmouth Health Department (PHD) is charged with the responsibility to <br />administer and enforce the provisions of Chapter 15, the "Food Code." <br />. Chapter 15 has been periodically revised, but is based on health and safety <br />principles for food and food service establishment that are obsolete and inconsistent <br />with surrounding localities. <br /> <br />Discussion: <br />. The Food and Drug Administration (FDA), an agency within the United States <br />Department of Health and Human Services, has developed a model food code that is a <br />uniform system of provisions that address the safety and protection of food at retail and <br />food service establishments. <br />. FDA updates the Model Food Code every four years to keep current with the <br />changes within the food industry. The current revisions were enacted in 2009. <br />. The Model Food Code is designed to specifically target the risk factors for <br />foodborne illnesses, enabling owners and managers of food service establishments to <br />better know what areas to monitor and control. <br />. PHD began notifying and soliciting feedback about the proposed code changes <br />from the approximately 440 foodservice establishments earlier this year in anticipation <br />of adoption of the FDA Model Food Code effective July 1, 2011. <br /> <br />Financial Impact: <br />. There is no financial impact to the City. Enforcement will not require any <br />additional personnel, operating or capital expenditures for the City. <br /> <br />Recommended Action: <br />. Adoption of an ordinance. Vision Principles: Bold New Directions and Thriving <br />Neighborhoods and a Sense of Community. <br /> <br />Next Steps Following Council Action: <br />. Continuation of education and training at food establishments and in required <br />classes. <br /> <br />Motion by Mr. Moody, and seconded by Mr. Randall, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />"ORDINANCE REPEALING CHAPTER 15 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (2006) AND ADOPTING A NEW CHAPTER 15.1 <br />PERTAINING TO FOOD AND FOOD ESTABLISHMENTS." <br /> <br />Ayes: Cherry, Edmonds, Heretick, Moody, Randall, Whitehurst, Wright <br />Nays: None <br /> <br />11 - 281 - Adoption of an ordinance accepting a grant in the amount of $572,829 <br />from the Virginia Department of Criminal Justice Services and appropriating said <br />amount in the FY 2011-12 Grants Fund to provide funding to operate local <br />probation and pretrial services. Vision Principle: Thriving Neighborhoods and a <br />Sense of Community. <br /> <br />Background: <br />. The Community Corrections & Pretrial Services Program has been continually <br />funded by the state since 1995. It is a diversion from incarceration program. <br />. This state funding allows us to provide quality supervision to non-violent <br />offenders and defendants in the community and directly impact the jail population. <br />
