Pitts, 4816 Mallard Crescent, representing, <br />Hunters Point Civic League, spoke in support of the project. <br /> <br /> Motion of Mr. Simpson and seconded by Mrs. Lucas, the <br />following resolution was adopted on fina~ re~ding, and by the <br />following vote: <br /> <br /> "A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT <br /> PURSUANT TO S~CTION 40-55 OF THE CODE OF THE CITY OF <br /> PORTSMOUTH, VIRGINIA, 1973, AS AMENDED, SAID PROJECT BEING <br /> LOCATED ON 10 ACRES OF PROPERTY OF THE FORMER BEASLEY F~-RM <br /> SITE AND CONSISTING OF 86 TOWNHOUSE UNITS AND DESIGNATEDi AS <br /> GHP-88-2. <br /> <br /> WHEREAS, Garcia-Gelardi DevelOpment Corporation has made <br />applicatiOn pursuant to ~40-55 of the Code of the City of <br />Portsmonth, Virginia, 1973, as amended, for the granting and <br />approval of a group housing project consisting of eighty,six (86) <br />townhouse units on Parcel 4-C of the Riverpoint Subdivision, such <br />parcel being approximately 10 acres of property on the northern <br />portion of ithe former Beasley Farm and designated as GHP-88-2, <br />such parcel~being a portion of Parcel 4 in Zoning Amendment <br />Ordinance Z~85.21; and <br /> <br /> W~EREAS, the applicant has been determined by the Planning <br />Commission to have met the requirements of ~40-55 of the Code of <br />the City. Of Portsmouth, Virginia 1973, as amended; and <br /> <br /> WHEREAS, the Planning Commission has reviewed such <br />application and site plans submitted therewith and has recommended <br />conditional approval of said application; and <br /> <br /> WHEREAS, the developer has been informed that approval of a <br />group housing project pursuant to ~40-55 grants only an exemption <br />from certain requirements for residences as stated in said section <br />and does not constitute a waiver of any~other requirement embodied <br />in the Subdivision Ordinance, Zoning Ordinance, Code of the City <br />of Portsmouth, Virginia, Or any'other' applicable local, state'or <br />federal law or regulation; and <br /> <br /> <br />
