May 24, 1988 <br /> <br /> (c) Resolution to grant a use permit to George T. McLean <br />Company, owner, for a coal slag processing plant at 3310 <br />George Washington, approved on first reading at the <br />Public Hearing of May 9, 1988, was taken up and read. <br />(UP-88-7) <br /> <br /> Motion of Mr. Simpson and seconded by Mr. Barnes, the <br />following resolution was adopted on final reading, and by the <br />following vote: <br /> <br />"A RESOLUTION GRANTING A USE PERMIT TO APACHE-BLAST, INC. <br />TO OPERATE A COAL SLAG PROCESSING PLANT AT 3310 GEORGE <br />WASHINGTON HIGHWAY. <br /> <br /> WHEREAS, Richard S. Couch, Vice President of Apache~Blast, <br />Inc., has made application pursuant to Section 40-69 (b) of the <br />Code of the City of Portsmouth, Virginia, 1973, for the <br />granting of a use permit as hereinafter-described; and <br /> <br /> WHEREAS, the applicant and the Planning <br />all things required to be done in connection <br />application; and <br /> <br />Director have done <br />with said <br /> <br /> WHEREAS, the Planning Commission has recommended the <br />granting of said use permit, with conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia: <br /> <br /> 1. That the use for which the use permit <br />hereinafter-described is sought: <br /> <br /> (a) <br />persons <br />use; <br /> <br /> Will not adversely affect the health and!safety of <br />residing or working in the neighborhood of the proposed <br /> <br /> (b) Will not be detrimental to the public use or <br />injurious to the property or improvements in the neighborhood; <br />and <br /> <br /> (c) Will be in accordance with the purposes of the Zoning <br />Chapter of the City Code. <br /> <br /> 2. Apache-Blast, Inc. is hereby granted a use permit <br />pursuant to Sectlon 40-69 (b) of the Code of the City of <br />Portsmouth to operate a coal slag processing plant on 9.180 <br />acres at 3310 George Washington Highway, such parcel being more <br />specifically described as Tax Map 133, Parcel 9 (UP-88-7). <br /> <br /> 3. This use permit is approved subject to the following <br />conditions: <br /> <br /> (1) Ail required local, state and federal permits, <br />including but not limited to, a permit from the State Air <br />Pollution Control Board, must be obtained prior to commencement <br />of operation. <br /> <br /> (2) The Company will operate during the hours of 8:00 a. <br />m. to 6:00 p. m. on Monday through Saturday. <br /> <br /> (3) Storage piles of raw materials will not exceed 10' in <br />height. <br /> <br /> (4) The coal slag processing operation will be limited to <br />that portion of the site being descr~ibed as follows: <br /> <br /> <br />
