July 25, 2000 <br /> <br /> (h) The applicant shall be responsible for the design and construction of water <br />and sewer lines to City specifications in City-approved easements. Plans and actual <br />construction must be approved by the Director of Public Utilities prior to the acceptance <br />of such utilities by the City of Portsmouth. <br /> <br /> (i) The developer shall secure the approval of the roadway and parking area <br />construction specifications by the Director of Public Works. <br /> <br /> (j) The developer shall be responsible for making necessary arrangements <br />through private service or the City of Portsmouth to provide trash and bulk waste pick- <br />up services to the development. <br /> <br /> (k) The condominium association shall be responsible for maintaining the <br />roadways, the street lighting, the BMPs and all recreation and common areas within the <br />development site. <br /> <br /> (I) Any revisions to the site plan, landscaping plan, or elevations made <br />through the Group Housing Use Permit process and changes necessitated by technical <br />reviews of the detailed engineering plans must be submitted to the Director of <br />Community Quality and Planning Services for approval prior to the issuance of building <br />permits. <br /> <br /> (m) Continuous unimpeded access to the privately owned parcels for private <br />vehicles, service vehicles and public safety vehicles must be maintained at all times <br />during the site development and building construction process. <br /> <br /> (n) Signs prohibiting parallel parking along the interior roadways shall be <br />posted prior to issuance of any Certificate of Use and Occupancy. <br /> <br /> (o) The developer shall improve the private park area shown in the southeast <br />corner of the preliminary site plan as follows: one 15' x 20' roofed picnic shelter with a <br />concrete floor, six picnic tables, two permanently fixed charcoal grills, and two <br />permanently fixed trash receptacles. <br /> <br /> Such improvements must be installed no later than sixty days after the <br />issuance of the final Certificate of Use and Occupancy for the final unit in the <br />development. Should the developer seek the issuance of a Certificate of Use and <br />Occupancy for the last of the twenty-one buildings prior to fulfillment of this condition, a <br />performance bond committing construction of the improvement or the payment of <br />$10,000 shall be posted in a form acceptable to the City Attorney's Office. Alternative <br />improvements valued at $10,000 may be substituted by majority vote of the River Pointe <br />Section 5 Homeowners Association with the approval of the Director of Community <br />Quality and Planning Services. <br /> <br /> (p) The developer will construct a boating facility as illustrated in the <br />preliminary site plan dated April 11, 2000 for the use of the River Pointe Section 5 <br />Homeowners Association. <br /> <br /> Such improvements must be installed no later than sixty days after the <br />issuance of the final Certificate of Use and Occupancy for the final unit in the <br />development. Alternative improvements valued at $7,500 may be substituted by <br />majority vote of the River Pointe Section 5 Homeowners Association with the approval <br />of the Director of Community Quality and Planning Services. Should the developer seek <br />the issuance of a Certificate of Use and Occupancy for the last of the twenty-one <br />buildings prior to fulfillment of this condition, a performance bond committing <br />construction of the improvement or the payment of $10,000 shall be posted in a form <br />acceptable to the City Attorney's Office. <br /> <br /> (q) The developer shall establish a restricted escrow account for the <br />enhancement of the existing recreation facility located on River Pointe Drive and shall <br />pay $100 into the account at closing on every Section 5 unit sold. Funds accumulated in <br />the escrow account shall periodically be transferred to the Board of Directors having <br />oversight of the facility. The final transfer shall take place at the closing for the sale of <br />the final unit in Section 5. <br /> <br /> <br />
