July 25, 2000 <br /> <br /> (d) The quantity, quality, utility, size and type of the project's open space and <br />landscaping improvements is sufficient to offset the decreases in dimensional <br />requirements or other deviations from the zoning district in which the project is located; <br /> <br /> (e) The project's internal traffic circulation system is adequate to provide for <br />the convenient and safe movement of vehicles and pedestrians, and the project will not <br />cause surrounding streets and roads to exceed their safe capacities; <br /> <br /> (f) The quantity, quality, utility and type of the project's community and <br />common facilities are sufficient to offset the decreases in dimensional requirements and <br />other deviations from the zoning district in which the project is located; <br /> <br /> (g) The project complies with the standards for approval of a use permit set <br />forth in Section 40-106 of the Code of the City of Portsmouth, Virginia; and <br /> <br /> (h) The project provides parking, building access and pathways for persons <br />with disabilities in accordance with the requirements of the Americans with Disabilities <br />Act. <br /> <br /> 2. That a group housing use permit for 102 condominium residential units in <br />Section 5 of River Pointe is hereby granted to the applicant, River Pointe Associates, <br />L.L.C., subject to the following terms and conditions: <br /> <br /> (a) The Group Housing project shall be limited to 102 condominium units in <br />21 buildings with access and other land use features as illustrated on the Preliminary <br />Site Plan dated June 29, 2000 (Rev A: July 13, 2000). The Director of Community <br />Quality and Planning Services may approve minor modifications to the plan to <br />accommodate engineering detail and necessary minor adjustments. <br /> <br /> (b) The developer shall construct the 102 condominium units in accordance to <br />the floor plans, building materials, (combination of brick, vinyl siding and vinyl cedar <br />shakes) shown on the applicant's submitted floor plans and elevations identified as <br />Exhibits A through E. Said Exhibits are attached hereto and made a part hereof. The <br />Director of Community Quality and Planning Services may approve minor modifications <br />to these details. The units shall be priced from a minimum base range of $125,000 to <br />$169,000 exclusive of any waterfront / water view premiums. <br /> <br /> (c) The development will be a controlled access community. The developer <br />shall construct a landscape buffer, including a berm and wall, along the length of the <br />property line abutting the Egrets Cove development. This feature will be subject to the <br />review and approval of the Director of Community Quality and Planning Services during <br />the technical review and approval process for the site plan. <br /> <br /> (d) A landscaping plan shall be developed in accordance with the preliminary <br />site plan and approved by the Director of Community Quality and Planning Services as <br />part of the site plan approval process and the Plan of Development Process outlined in <br />section 9.1-11 of the City Code (Chesapeake Bay Preservation Area Overlay <br />Ordinance). <br /> <br /> (e) The site plan shall conform to all requirements of the Chesapeake Bay <br />Preservation Area Overlay Ordinance. The Best Management Practices (BMPs) shown <br />on the site plan or subsequently added must be approved in all aspects including <br />capacity to offset impervious surfaces to be constructed in the landward 50' of the <br />Resource Protection Area by the Director of Public Works. <br /> <br /> (f) The applicant shall preserve and protect existing trees in the Resource <br />Protection Area (RPA) and shall adhere to the requirements for Resource Protection <br />Areas outlined in Sections 9.1-10 and 11 of the City Code (Chesapeake Bay <br />Preservation Area Overlay Ordinance). <br /> <br /> (g) The developer shall provide street lighting along the roadways and in all <br />parking areas in accordance with Illumination Engineering Standards for roadways. A <br />lighting plan for the development shall be approved by the Director of Public Works prior <br />to the issuance of building permits. <br /> <br /> <br />
