5.8 <br /> <br />July 12, 1988 <br /> <br /> 88-245 - The following ordinance approved on first reading <br />at the regular meeting of June 28, 1988, was taken up and read. <br /> <br />"AN ORDINANCE TO APPROPRIATE $80,000 FROM THE CAPITAL <br />IMPROVEMENT FUND FOR REPAIR AND REPLACEMENT OF ROOFS FOR <br />THE MAIN LIBRARY ON COURT STREET, THE COMMUNITY ARTS <br />CENTER, AND A PORTION OF THE FIRE DEPARTMENT HEkDQUARTERS <br />ON EFFINGHAM STREET. <br /> <br /> Motion of Mr. Simpson and seconded by Mr. Gray, the <br />ordinance was adopted on final reading: <br /> <br />Ayes: Barnes, Corprew, Gray, Hawks, Lucas, Simpson, Webb <br />Nays: None <br /> <br /> 88-247 - The following ordinance deferred at the regular <br />meeting of June 28, 1988, was taken up and read. <br /> <br /> "AN ORDINANCE TO AMEND SECTION 11-129 OF THE CO~E OF THE <br /> CITY OF PORTSMOUTH, VIRGINIA BY ADDING THERETO SUBSECTION <br /> 16 PERTAINING THE EXEMPTIONS FROM THE REQUIRED USE OF <br /> SEALED BIDDING OR COMPETITIVE NEGOTIATION. <br /> <br /> Motion of Mrs. Lucas and seconded by Mr. Simpson, the <br />ordinance was adopted on final reading: <br /> <br />Ayes: Barnes, Gray, Hawks, Lucas, Simpson, Webb <br />Nays: Corprew <br /> <br />REPORTS FROM THE CITY MANAGER - <br /> <br /> 88-266 - Letter from the City Manager recommending <br />adoption of an ordinance to amend the code of the City of <br />Portsmouth, Virginia, 1973, by adding Section 32-5.1 to Chapter <br />32 thereof pertaining to outdoor dining area permits. <br /> <br /> "City staff has received a number of requests from <br />merchants along High Street inquiring about the possibility of <br />allowing their establishments to encroach on City property for <br />the purpose of outdoor seating for restaurants. The <br />Departments of Economic Development, Public Works, Planning and <br />Public Health have been consulted and ~hey are in support of <br />the concept of outdoor dining. <br /> <br /> The City Attorney has researched the matter and has <br />prepared the attached ordinance w'hich will provide for the <br />establishment of outdoor dining areas. The proposed ordinance <br />would allow for an encroachment on C!ity sidewalks (maximum <br />distance from building, 5 feet) with the provision that <br />pedestrian access remain open (minimum'of an 8-foot walk-way <br />from any point). The ordinance would also require the issuance <br />of a permit and a requirement that the applicant fulfill all <br />other State or local requirements i.e., Health Department, D-l, <br />etc. <br /> <br /> I, therefore, recommend City Council's approval of the <br />proposed ordinance to establish outside dining areas." <br /> <br /> On motion of Mrs. Lucas and seconded by Mr. Simpson, the <br />following ordinance was adopted on first and final reading, and <br />by the following vote: <br /> <br /> <br />
