<br />January 25. 2011 <br /> <br />(f) Maintains safe and adequate egress and ingress onto the site and safe road <br />conditions around the site; <br /> <br />(g) Allows for the protection of property values and the ability of neighboring lands to <br />develop the uses permitted in their zoning district(s); <br /> <br />(h) Complies with all other city, state, and federal laws and regulations. <br /> <br />2. That the Railroad Museum of Virginia, Inc., is hereby granted a use permit <br />pursuant to Section 40.1-2.3B of the Code of the City of Portsmouth, Virginia (2006) for <br />the operation of a museum at 16 Crawford Circle, Portsmouth, Virginia, and being more <br />particularly described as: <br /> <br />UP-10-08 <br /> <br />16 Crawford Circle <br /> <br />All that certain piece or parcel of land situate in the City of Portsmouth, Virginia, being a <br />portion of the former railroad right of way granted to the City of Portsmouth by CSX <br />Transportation, Inc., by deed dated September 13, 2000, and duly recorded in Clerk's <br />Office of the Circuit Court of the City of Portsmouth, Virginia, in Deed Book 1311, at <br />page 122, being 37.50 feet in width and 467.00 feet more or less and running from the <br />east right of way line of PortCentre Parkway eastwardly 467.00', more or less, as <br />measured along the centerline of the track located thereon to the terminus of the track. <br /> <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicants and any successor in interest: <br /> <br />(a) No more than six special events involving the service of food or drinks shall be <br />held in any calendar year as long as the Railroad Museum is reliant on portable <br />restroom facilities. Should the Museum install or secure access to permanent rest <br />rooms on site or nearby, the number of events per calendar year shall no longer be <br />limited, as deemed acceptable to the Building Official. <br /> <br />(b) Prior to opening rail cars to the public, the cars shall be inspected and certified to <br />be free of lead, asbestos and any other air borne material(s) hazardous to human health <br />by a qualified independent inspector licensed by the Commonwealth of Virginia. <br /> <br />(c) Amplified music or amplified entertainment is prohibited unless a separate <br />entertainment activity use permit has been issued by the City of Portsmouth. <br /> <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City CounciL" <br /> <br />Ayes: Cherry, Edmonds, Heretick, Moody, Randall, Wright <br />Nays: None <br /> <br />- City Manager's Report - <br /> <br />11 - 40 - Adoption of an ordinance to amend Chapter 16 of the Code of the City of <br />Portsmouth, Virginia (2006) by amending Section 16-64 thereof and by amending <br />Appendix A thereof to decrease monthly rates for trash and garbage disposal. Vision <br />Principle: A Robust and Prospering Economy. <br /> <br />Background: <br />. In April 2009, SPSA increased tipping fees from $104/ton to $170/ton. <br />. In May 2010, SPSA decreased tipping fees from $170/ton to $150/ton. <br />. New fees and charges adopted by the Southeastern Public Service Authority <br />(SPSA) which became effective on January 1, 2011, lowered tipping fees from $150 per <br />ton to $145 per ton. <br />. The City sends approximately 45,000 tons of garbage to SPSA facilities each <br />year. <br />
