January 25. 2011 (f) Maintains safe and adequate egress and ingress onto the site and safe road conditions around the site; (g) Allows for the protection of property values and the ability of neighboring lands to develop the uses permitted in their zoning district(s); (h) Complies with all other city, state, and federal laws and regulations. 2. That the Railroad Museum of Virginia, Inc., is hereby granted a use permit pursuant to Section 40.1-2.3B of the Code of the City of Portsmouth, Virginia (2006) for the operation of a museum at 16 Crawford Circle, Portsmouth, Virginia, and being more particularly described as: UP-10-08 16 Crawford Circle All that certain piece or parcel of land situate in the City of Portsmouth, Virginia, being a portion of the former railroad right of way granted to the City of Portsmouth by CSX Transportation, Inc., by deed dated September 13, 2000, and duly recorded in Clerk's Office of the Circuit Court of the City of Portsmouth, Virginia, in Deed Book 1311, at page 122, being 37.50 feet in width and 467.00 feet more or less and running from the east right of way line of PortCentre Parkway eastwardly 467.00', more or less, as measured along the centerline of the track located thereon to the terminus of the track. 3. That the use permit is approved subject to the following conditions which shall be observed by the applicants and any successor in interest: (a) No more than six special events involving the service of food or drinks shall be held in any calendar year as long as the Railroad Museum is reliant on portable restroom facilities. Should the Museum install or secure access to permanent rest rooms on site or nearby, the number of events per calendar year shall no longer be limited, as deemed acceptable to the Building Official. (b) Prior to opening rail cars to the public, the cars shall be inspected and certified to be free of lead, asbestos and any other air borne material(s) hazardous to human health by a qualified independent inspector licensed by the Commonwealth of Virginia. (c) Amplified music or amplified entertainment is prohibited unless a separate entertainment activity use permit has been issued by the City of Portsmouth. 4. The City sends approximately 45,000 tons of garbage to SPSA facilities each year.
