<br />Januarv 25. 2011 <br /> <br />At a Regular Meeting of the City Council on Tuesday, January 25, 2011, there <br />were present: <br /> <br />Mayor Kenneth I. Wright, William E. Moody, Jr., Marlene W. Randall, Stephen E. <br />Heretick, Paige D. Cherry, Dr. Curtis E. Edmonds, Sr., City Manager Kenneth L. <br />Chandler, City Attorney G. Timothy Oksman. <br /> <br />Trustee Curtis E. Edmonds, Jr., opened the meeting with prayer, which was <br />followed by the Pledge of Allegiance to the Flag. <br /> <br />Mayor Wright called the meeting to order and welcomed all in attendance. <br /> <br />Motion by Mr. Moody, and seconded by Mr. Heretick, to approve the minutes of a <br />Called Meeting of January 11, 2011, of a Regular Meeting of January 11, 2011, and of a <br />Called Meeting of January 18, 2011, and was adopted by the following vote: <br /> <br />Ayes: Cherry, Edmonds, Heretick, Moody, Randall, Wright <br />Nays: None <br /> <br />- Unfinished Business - <br /> <br />11 - 14 - Use permit: <br /> <br />Motion by Mr. Heretick, and seconded by Ms. Randall, to adopt the following <br />resolution approved on first reading at the January 11, 2011 meeting, and was adopted <br />by the following vote: <br /> <br />11-14: <br /> <br />"RESOLUTION GRANTING A USE PERMIT TO THE RAILROAD MUSEUM OF <br />VIRGINIA, INC., TO OPERATE A MUSEUM AT 16 CRAWFORD CIRCLE. <br /> <br />WHEREAS, the Railroad Museum of Virginia, Inc., has made application <br />pursuant to Section 40.1-2.3 B of the Code of the City of Portsmouth, Virginia (2006) for <br />the granting of a use permit for the operation of a museum at 16 Crawford Circle, <br />Portsmouth, Virginia; and <br /> <br />WHEREAS, the applicant and the Planning Director have done all things <br />required to be done in connection with said application; and <br /> <br />WHEREAS, the Planning Commission has recommended the granting of the <br />application for a use permit with conditions. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1. That it finds that the use for which the permit is sought: <br /> <br />(a) Complies with the applicable standards of the Zoning Ordinance; <br /> <br />(b) Is consistent with the comprehensive plan; <br /> <br />(c) Is compatible with the character of surrounding lands and the uses permitted in <br />the subject property's zoning district; <br /> <br />(d) Is configured to minimize adverse effects, including the visual impacts of the <br />proposed use on adjacent lands; <br /> <br />(e) Avoids significant deterioration of water and air resources, and other natural <br />resources; <br />
