249 <br /> <br />November 8, 1988 <br /> <br /> William Griffin, 2018 Atlanta Avenue~ spoke concerning <br />property at 930 County Street, as he is a Trustee for the Church. <br /> <br /> Matthew E. <br />the property of <br />Street. <br /> <br />Peanort, Sr., 211 Woodstock Street, asked about <br />the Arabian Temple in the 700 block of Queen <br /> <br />Danny Cruce, answered questions of the speakers. <br /> <br />No action taken. <br /> <br />- UNFINISHED BUSINESS <br /> <br />88-338 - Group Housing Project: <br /> <br />(e) <br /> <br />Resolution granting a group Rousing permit to <br />Bayside Building Corporation for 89 apartment <br />units at 100 Elliott Avenue, approved on first <br />reading at the regular meeting of October 25, <br />1988, was taken~up and read. <br /> <br /> On motion of Mr. Gray and seconded by Mr. Simpson, the <br />following resolution was adopted on final reading and by the <br />following vote: <br /> <br />"A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT <br />PURSUANT TO SECTION 40-55 OF THE CODE OF T~E CITY OF <br />PORTSMOUTH, VIRGINIA, 1973, AS AMENDED, SAID PROJECT <br />CONSISTING -OF~-89 UNITS AT t00 ELL~OTT AVENUE AND DESIGNATED <br />AS GHP-88-5. <br /> <br /> WHEREAS, Bayside Building Corporation, ~ Donald n. Williams, <br />has made application pursuant to Section 40-~ of the code of the <br />City of Portsmouth, Virginia, 1973, for the granting and approval <br />of a group housing project consisting of eight-nine (89) apartment <br />units at 100 Elliott Avenue; and <br /> <br /> WHEREAS, the application has been determined by the Planning <br />Commission to have met the requirements of Section 40-55 of the <br />Code of the City of Portsmouth, Virginia; and <br /> <br /> WHEREAS, the Planning Commission has reviewed such <br />application and site plan submitted therewith and has recommended <br />conditional approval of said application; and <br /> <br /> WHEREAS, the developer has amended the application and site <br />plan submitted and has requested approval of an amended project <br />from the City Council; and <br /> <br /> WHEREAS, the developer has been informed that approval of the <br />group housing project pursuant to Section 40-55 grants only ~n <br />exemption from certain requirements for residences stated in|said <br />section and does not constitute a waiver of any other requirement <br />embodied in the Subdivision Ordinance, Zoning Ordinance, Code of <br />the City of Portsmouth, Virginia, or any other applicable local, <br />state or federal law or regulation; and <br /> <br /> WHEREAS, the developer is aware that building permits or any <br />other required permit will be issued only upon compliance with the <br />ordinancesr laws or regulations applicable thereto. <br /> <br /> <br />
