249 November 8, 1988 William Griffin, 2018 Atlanta Avenue~ spoke concerning property at 930 County Street, as he is a Trustee for the Church. Matthew E. the property of Street. Peanort, Sr., 211 Woodstock Street, asked about the Arabian Temple in the 700 block of Queen Danny Cruce, answered questions of the speakers. No action taken. - UNFINISHED BUSINESS 88-338 - Group Housing Project: (e) Resolution granting a group Rousing permit to Bayside Building Corporation for 89 apartment units at 100 Elliott Avenue, approved on first reading at the regular meeting of October 25, 1988, was taken~up and read. On motion of Mr. Gray and seconded by Mr. Simpson, the following resolution was adopted on final reading and by the following vote: "A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT PURSUANT TO SECTION 40-55 OF THE CODE OF T~E CITY OF PORTSMOUTH, VIRGINIA, 1973, AS AMENDED, SAID PROJECT CONSISTING -OF~-89 UNITS AT t00 ELL~OTT AVENUE AND DESIGNATED AS GHP-88-5. WHEREAS, Bayside Building Corporation, ~ Donald n. Williams, has made application pursuant to Section 40-~ of the code of the City of Portsmouth, Virginia, 1973, for the granting and approval of a group housing project consisting of eight-nine (89) apartment units at 100 Elliott Avenue; and WHEREAS, the application has been determined by the Planning Commission to have met the requirements of Section 40-55 of the Code of the City of Portsmouth, Virginia; and WHEREAS, the Planning Commission has reviewed such application and site plan submitted therewith and has recommended conditional approval of said application; and WHEREAS, the developer has amended the application and site plan submitted and has requested approval of an amended project from the City Council; and WHEREAS, the developer has been informed that approval of the group housing project pursuant to Section 40-55 grants only ~n exemption from certain requirements for residences stated in|said section and does not constitute a waiver of any other requirement embodied in the Subdivision Ordinance, Zoning Ordinance, Code of the City of Portsmouth, Virginia, or any other applicable local, state or federal law or regulation; and WHEREAS, the developer is aware that building permits or any other required permit will be issued only upon compliance with the ordinancesr laws or regulations applicable thereto.
