November 8, 1988 <br /> <br /> "On October 11, 1988, the City Council: in accordance with <br />Section 30-19.04 of the Code of Virginia, held a public hearin§ <br />to consider the application for exemption from taxes filed on <br />behalf of the Chisholm Foundation, Inc. for property located in <br />the City of Portsmouth and used by tke~applicant exclusively <br />for charitable and benevolent purposes on a non-profit basis as <br />set forth ~in Sec%i~on 58.1--3650 of the Code of Virginia. <br /> <br /> ~The .Ci~%y~As'ses's~ has-reviewed .the application of' the <br />organization in accordance with the requirements of~ law and is <br />of the opinion that the appropriate responses were completed <br />and that the-~orga~hization .makes use ofTM its property located <br />wit.hin the City~ Of~ Portsmouth exclusively for c~%ari%ab_le and <br />benevolent~'purpD~es- on a non-profit basis. I- Concur in the <br />City Assessor's opinion and recommend that Cou~ci'l ad'opt the <br />resolution prepared by the City Attorney for forwarding to the <br />Portsmouth eleg~ron to the General i~ssembly~ <br /> <br /> Motion of Mr. Barnes and seconded by Mr. Gray, the <br />following resolution was adopted and by the following vote: <br /> <br />"A .RESOLUTION SUPRORTING T~E APPLICATION OF~CHISHOLM <br />FOUNDAT~ON,~ INC., FOR DESIGNATION AS A CHARITABSE ~AND <br />BENEVOLENT OR~ANIZATION WITHIN THE CONTEXT OF SECTION <br />~(a)-~(-6) OP ~ARTICLE X OF THE CONSTITUTION OFTM VIRGINIa. <br /> <br /> WHEREAS, in-accordance with §30-19.04 of the Code of <br />V~rginia, I950, as amended, the council of the ~City of <br />Portsmouth, Virqinia held a Public Hearing on Tuesday, October <br />11, 1988 to consider the application for exemption from taxes <br />filed On bekalf ~of Chisholm Foundation, Inc. for property <br />located within~he~Eity of Portsmouth, Virgin~ia, and used by <br />the applican~.e~clusively for charitable and benevolent <br />purposes on a non-profit basis as set forth in §58.1-3650 of <br />the C~de of ~Vir~nia~ 1950, as amended; and <br /> <br /> WHEREkS~ ~he Council of the City Of Portsmouth, Virginia <br />has examined and considered the provisions of ~30-19.04 (B) of <br />the Code of Virginia, 1950, as amended, with respect to the <br />petition of Chi~holmFoundation, .Inc'.. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED that the Council of the <br />City of Portsmouth, Virginia supports the request of Chisholm <br />Foundation, Inc., a non-profit organization, for designation as <br />a cha~itable~an~d benevolent organization within the context of <br />§6 (a) (6] of~i~rticle X of the Constitution of Virginia and <br />that its property located within the City of Portsmouth, owned <br />by it and user,by ~t e~clusively for charitable and benevolent <br />purposes on a ~on-prof'it basis, be determined to be~ exempt from <br />taxation in accordance .with ~58.-1-3650 of the-Code of Virginia, <br />1950, as amended. <br /> <br /> BE IT FUR~ER RESOLVED that the City Clerk be, and she <br />hereby is, directed to forward copies of this Resolution to <br />State Senator Johnny S. Joannou and Delegates William S. Moore, <br />Jr. and KennethR.
