November 8, 1988 "On October 11, 1988, the City Council: in accordance with Section 30-19.04 of the Code of Virginia, held a public hearin§ to consider the application for exemption from taxes filed on behalf of the Chisholm Foundation, Inc. for property located in the City of Portsmouth and used by tke~applicant exclusively for charitable and benevolent purposes on a non-profit basis as set forth ~in Sec%i~on 58.1--3650 of the Code of Virginia. ~The .Ci~%y~As'ses's~ has-reviewed .the application of' the organization in accordance with the requirements of~ law and is of the opinion that the appropriate responses were completed and that the-~orga~hization .makes use ofTM its property located wit.hin the City~ Of~ Portsmouth exclusively for c~%ari%ab_le and benevolent~'purpD~es- on a non-profit basis. I- Concur in the City Assessor's opinion and recommend that Cou~ci'l ad'opt the resolution prepared by the City Attorney for forwarding to the Portsmouth eleg~ron to the General i~ssembly~ Motion of Mr. Barnes and seconded by Mr. Gray, the following resolution was adopted and by the following vote: "A .RESOLUTION SUPRORTING T~E APPLICATION OF~CHISHOLM FOUNDAT~ON,~ INC., FOR DESIGNATION AS A CHARITABSE ~AND BENEVOLENT OR~ANIZATION WITHIN THE CONTEXT OF SECTION ~(a)-~(-6) OP ~ARTICLE X OF THE CONSTITUTION OFTM VIRGINIa. WHEREAS, in-accordance with §30-19.04 of the Code of V~rginia, I950, as amended, the council of the ~City of Portsmouth, Virqinia held a Public Hearing on Tuesday, October 11, 1988 to consider the application for exemption from taxes filed On bekalf ~of Chisholm Foundation, Inc. for property located within~he~Eity of Portsmouth, Virgin~ia, and used by the applican~.e~clusively for charitable and benevolent purposes on a non-profit basis as set forth in §58.1-3650 of the C~de of ~Vir~nia~ 1950, as amended; and WHEREkS~ ~he Council of the City Of Portsmouth, Virginia has examined and considered the provisions of ~30-19.04 (B) of the Code of Virginia, 1950, as amended, with respect to the petition of Chi~holmFoundation, .Inc'.. NOW, THEREFORE, BE IT RESOLVED that the Council of the City of Portsmouth, Virginia supports the request of Chisholm Foundation, Inc., a non-profit organization, for designation as a cha~itable~an~d benevolent organization within the context of §6 (a) (6] of~i~rticle X of the Constitution of Virginia and that its property located within the City of Portsmouth, owned by it and user,by ~t e~clusively for charitable and benevolent purposes on a ~on-prof'it basis, be determined to be~ exempt from taxation in accordance .with ~58.-1-3650 of the-Code of Virginia, 1950, as amended. BE IT FUR~ER RESOLVED that the City Clerk be, and she hereby is, directed to forward copies of this Resolution to State Senator Johnny S. Joannou and Delegates William S. Moore, Jr. and KennethR. Melvin."
