<br />September 28. 2010 <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia, that it endorses the attached legislative proposals for the 2011 <br />General Assembly session and directs that both this resolution and the legislative <br />proposals be forwarded to the Portsmouth General Assembly delegation." <br /> <br />Ayes: Cherry, Heretick, Moody, Psi mas, Randall, Whitehurst, Griffin <br />Nays: None <br /> <br />Motion by Mr. Whitehurst, and seconded by Mr. Moody, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />10-451 (B): <br /> <br />"RESOLUTION ENDORSING THE CITY'S 2012 FEDERAL LEGISLATIVE AGENDA <br />PACKAGE. <br /> <br />WHEREAS, the United States Congress deals with a broad range of issues that <br />affect local government both directly and indirectly; and <br /> <br />WHEREAS, the City of Portsmouth has certain concerns that deal with both <br />Portsmouth specifically and local governments in general; and <br /> <br />WHEREAS, these concerns need to be made known to Portsmouth's <br />congressional delegation so that they may be transmitted for consideration by the <br />Senate and the House of Representatives. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia, that it endorses the attached Fiscal Year 2012 Federal Priorities <br />for the113th Congress and directs that both this resolution and the requests therein be <br />forwarded to the City's congressional representatives." <br /> <br />Ayes: Cherry, Heretick, Moody, Psi mas, Randall, Whitehurst, Griffin <br />Nays: None <br /> <br />10 - 452 - Adoption of a resolution authorizing the Department of Public Utilities to <br />exceed by 25% or more, selected contracts for the Prentis Park Utility Replacement <br />Project. Vision Principles: A Robust and Prospering Economy and Thriving <br />Neighborhoods and a Sense of Community. <br /> <br />Background: <br />. The Prentis Park Utility Replacement project has been a high priority in the City's <br />Capital Improvements Plan and is currently under construction. <br />. The City received $4.8 million in ARRA stimulus funds to help pay for this project, <br />which required all phases to be under construction in order to receive the funding. <br />Original plans called for this project to be completed in a series of phases over several <br />years. As a result, there are five different contractors currently working in the <br />neighborhood, and completion of all phases is expected by the end of February 2011. <br />. Many of the roads in Prentis Park are not constructed to current standards, have <br />very little base material to support the asphalt, and have rapidly deteriorated due in part <br />to the volume of construction traffic that is present with having five contractors working <br />at the same time. <br />. Because of these conditions, more extensive roadway restoration is required <br />than originally anticipated and specified in the bid documents. This includes the total <br />rebuilding of numerous sections of roads in the neighborhood. <br /> <br />. City Council policy requires that any change orders that will exceed 25% of a <br />contract's cost must be approved by City Council. <br />
