287 <br /> <br />December 13, 1988 <br /> <br /> 88-492 - Letter from the City Manager recommending adoption <br />of an ordinance to amend Sections 32=123 and 32-128 of the Code of <br />the City of~Portsmouth, ~irginia, 1973~ as amended, pertaining to <br />sales.on'streets and sidewalks. <br /> <br /> "At your Tuesday; July 6, 1988 Council meeting, an ordinance <br />was adopted to allow for sidewalk vendors and pushcarts within the <br />City. At the time that the ordinance was created, it was the <br />understanding that the law office and staff would continue their <br />research and bring an subsequent amendments back for City <br />Council's consideration. As part of this review, two additions <br />are proposed: <br /> <br />Section <br /> <br />32-123 - Provision allowing for D-1 review <br /> based upon criteria established to review <br /> design, material and color i.e., <br /> aesthetics of pushcarts. Provision to <br /> establish a procedure, for annual <br /> .... ,-~acceptance of~applications for permits. <br /> <br />Section 32-128~- Delete the reference to 1988. <br /> <br /> The firm which participated in the Priority Action Plan, Land <br />Design~Research, Inc., was contacted and requested to draft <br />criteria for aesthetic review of pushcarts. This criteria will bs <br />forwarded to the D-1 Committee4~ for their sue in awarding <br />certificates of compliance. On December 7, 1988, staff met with <br />Mrs. Janice Hoffman (existing vendor) and reviewed the draft <br />criteria. ~With the exception of the "spoke wheels" requirement~ <br />Mrs. Hoffman's psuchcart is in compliance. Mrs. Hoffman indicate~ <br />that she is looking into purchasing a new pushcart (with spoked <br />wheels); however, she requested that the reference to spoke wheels <br />be deleted from the proposed criteria. <br /> <br /> I concur with the recommendations, including Mrs. Hoffman's <br />request and recommend your approval." <br /> <br /> On motion of Mr. Simpson and seconded by Mrs. Lucas the <br />following ordinance was adopted on first and final reading, and <br />the following vote: <br /> <br />"AN ORDINANCE TO AMEND SECTIONS 32-123 AND 32-128 OF THE <br />CODE OF THE CITY OF PORTSMOUTHt VIRGINIA, 1973, AS <br />AMENDED, PERTAINING TO SALES ON STREETS AND SIDEWALKS." <br /> <br />Ayes: Barnes, Corprew, Gray, Hawks, Lucas, Simpson, WeDb <br />Nays: None <br /> <br /> 88-493 - Letter from the City Manager ~ecommending adoption <br />of an ordinance to amend the Code of the City of Portsmouth, <br />Virginia, by amending Section 35-224 (e) and (f) and Sectio~ <br />35-225 (a) pertaining to exemption of Real Estate Taxes for <br />certain elderly and permanently disabled people. <br /> <br /> "Please find at~ached amendments to the City Code which will <br />increase both benefit provisions and convenience to applicants of <br />the present Tax Relief Program. <br /> <br /> <br />
