329 <br /> <br />January 24, 1989 <br /> <br /> At a regular meeting of the City Council held on Tuesday, <br />January 24', 1989, there were present: <br /> <br />Mayor Gloria O. Webb, Wice Mayor J. Robert Gray, Jack P. <br />Barnes, E. G. Corprew, Jr., James C. Hawks, L. Louise Lucas <br />J. Herbert Simpson, George L. Hanbury, II, City Manager, <br />Steven Lieberman, City Attorney. <br /> <br /> Reverend Devlaming A. Peace, Pastor, Zion Bethel United <br />Church of Christ, opened the meeting with prayer, followed by <br />Pledge of Allegiance to the Flag. <br /> <br />the <br /> <br />Mayor Webb welcomed all visitors in attendance. <br /> <br /> Motion of Mr. Gray and seconded by Mr. Simpson, minutes of a <br />called meeting of January 4, 1989; minutes of a Public Hearing of <br />January 9, 1989; minutes of a called meeting of January 10, 1989 <br />minutes 6f a regular meeting of January 10, 1989; minutes of a <br />special called meeting of January 17, 1989, to be approved as <br />received, and was adopted by unanimous vote. <br /> <br />UNFINISHED BUSINESS <br /> <br />Consent Agenda <br /> <br /> On motion of Mr. Gray and seconded by Mr. Simpson, the <br />following items approved on first reading at the Public Hearing <br />of January 9, 1989 and the regular meeting of January 10, 1989, <br />were adopted on final reading, and by the following vote: <br /> <br /> 89-001 Rezoning, Use Permit and Group Housing project <br />applications: <br /> <br />(b) "ZONING ORDINANCE AMENDMENT Z-88-14". <br /> <br /> (c) "A-RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING <br />PROJECT PURSUANT TO SECTION 40-55 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA, 1973, CONSISTING OF SIX APARTMENTS IN A <br />MIXED USE DEVELOPMENT AT 1927 HIGH STREET. <br /> <br /> WIqEREAS, Quarter Century Corporation, by Kirk Berkley, has <br />made application pursuant to ~40-55 of the Code of the City of <br />Portsmouth, Virginia, 1973, as amended, for the granting and <br />approval of a group housing project consisting of six (6) <br />apartments to be developed-in a mixed use development at 1927 Hig! <br />Street, such premises further described as Tax Map 169, Parcels 7 <br />8, 21~ and 9.1, and such group housin] project having been <br />designated as GHP-88-6 and consisting of two (2) units on the <br />first floor and four (4) units on the second floor within the <br />structure on the property; and <br /> <br /> WHEREAS, the application has been determined by the Planning <br />Commission to have met the requirements of ~40-55 of the Code of <br />the City of Portsmouth, Virginia, 1973, as amended, and the <br />Planning Commission has reviewed such application and site plan <br />submitted therewith and has recommended a conditional approval of <br />said application; and <br /> <br /> WHEREAS, the developer has been informed that approval of a <br />group housing project pursuant to ~40-55 grants only an exemption <br />from certain requirements for residences as stated in said <br />section, and does not constitute a waiver of any other requiremen <br />embodied in the Subdivision Ordinance, Zoning Ordinance, Code of <br />the City of Portsmouth, or any other applicable local, state or <br />federal law or regu!ation~ and <br /> <br /> WHEREAS, the developer is aware that building permits or any <br />other required permit be issued only upon compliance with the <br />ordinances, laws, or regulations applicable thereto. <br /> <br /> <br />
