<br />July 27.2010 <br /> <br />- City Manager's Report - <br /> <br />10 - 348 - Adoption of an ordinance appropriating $150,000 in the FY 2010-2011 Capital <br />Improvement Program Fund for repairs to the Effingham Fire Station. Vision Principle: <br />Thriving Neighborhoods and a Sense of Community. <br /> <br />Background: <br />. The Effingham Fire Station experienced excessive settlement of its foundation <br />shortly after the completion of its construction. An injection process was utilized on two <br />occasions to minimize the effects of the settlement as much as possible. During this <br />time the City Attorney's office pursued a legal remedy to the resulting damage. <br /> <br />Discussion: <br />. The legal efforts were settled through mediation with a settlement amount of <br />$150,000. It is requested that the settlement funds be placed into the CIP project for <br />the Effingham fire station to complete as many of the remaining repairs as possible. The <br />remaining repairs have been minimized by previous efforts but the need may continue <br />for some time. <br /> <br />Financial Impact: <br />. The $150,000 will be placed in the Effingham Fire Station CIP project. These <br />funds should be sufficient to complete the majority of the repairs. <br /> <br />Recommended Action: <br />. Adoption of an ordinance appropriating $150,000 to the CIP fund for the <br />Effingham Fire Station Project. Vision Principle: Thriving Neighborhoods and a Sense <br />of Community. <br /> <br />Next Steps: <br />. Proceed with the necessary repairs. <br /> <br />Motion by Mr. Heretick, and seconded by Ms. Randall, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />"ORDINANCE APPROPRIATING $150,000 IN THE FY 2010-2011 CAPITAL <br />IMPROVEMENT FUND FOR REPAIRS TO THE EFFINGHAM FIRE STATION." <br /> <br />Ayes: Cherry, Heretick, Moody, Psi mas, Randall, Whitehurst <br />Nays: None <br /> <br />10 - 349 - Adoption of an ordinance appropriating the sum of $201,030 in the FY 2010- <br />2011 General Fund in funds paid in lieu of taxes by the Virginia Department of <br />Transportation to address the additional impact on local roads caused by Virginia Port <br />Authority activities. Vision Principle: Thriving Neighborhoods and a Sense of <br />Community. <br /> <br />Background: <br />. The General Assembly included language in the 2007 Appropriations Act <br />authorizing the Commonwealth Transportation Board (CTB) to make payments in lieu of <br />taxes (PILOT) to jurisdictions in which the Virginia Port Authority owns tax exempt real <br />estate. The PILOT payment to Portsmouth is $201,030. <br /> <br />Discussion: <br />. These funds represent impact to city streets as a result of the presence of the <br />Virginia Port Authority. <br />. The City of Portsmouth receives funding annually from the Virginia Department of <br />Transportation towards the cost of maintaining city streets. This supplemental payment <br />will be made to the City of Portsmouth as an increase to normal highway maintenance <br />funds. These funds are received annually based on the number of lane miles of streets <br />in the city of Portsmouth. These funds are dispersed quarterly and may only be utilized <br />on maintenance and improvements within City Rights of Way. The subject PILOT <br />payment will be included in our normal maintenance funds. <br />
