365 February ~28, 1989 (a) Will not adversely affect the health and safety of perSOns residing or working in the neighborhood of the proposed use; : , (b) Will not be detrimental to:the public use or injurious to the property or improvements of the;neighborhood; and (c) Will be in accordance with the purposes of the Zoning Chapter of the City Code. (2) Amoco Oil Company are hereby granted a use permit pursuant to ~40-t02 (I): (1) of the Code of the City of Portsmouth Virginia~ 1973, for the operation of gasoline pumps in con3 with a Convenience Store on property located at 2210 Portsmouth BoUlevard and being moreparticularly described aS follows: UP-88.17 BEGINNING at the southwest inters~cti0n Of.Frederick and Dee Creek Boulevards; thence!westerly along the south:right-of-wa~ Deep Creek Boulevard 211'+ to a.point; thence southeasterly 217'+ to the north right-of-way--of Portsmouth Boulevard; thence easter~ along said right-of-way 325'+ to the west right-of-way of Frederick BOulevard; thence ~orthwesterly 325'+ to the south right-of-way of Deep Creek BouleVard; the Poin~ of Beginning. (3) This use permit is approved subject to the following conditions: (a) The development muSt be in accordance with the sit plan approved by the Commission of Architectural Review. (b) Approval must be obtained from ~he Commission of Architectural Review for all signs prior to their installation." 89-49 (b) "A RESOLUTION GRANTING A USE PERMIT TO EARL Jo COOK, SR. TO OPERATE A JUNKYARD AT 703-705 JAMESTOWN AVENUE AND AT 705-707 YORKTOWN AVENUE. WHEREAS, Earl J. Cook, Sr. had been granted a use permit to operate a junkyard at 703-705 Jamestown Avenue by Resolution 82-5( adopted by the Council of the City of Portsmouth, Virginia at a meeting held June 22, 1982 and designated as UP-82-12; and WHEREAS, Earl J. Cook, Sr. had been;granted a use permit to operate an auto junkyard at 705-707 Yorktown Avenue by resolution 1983-90 adopted by the Council of the City of Portsmouth, Virginie at a meeting held September 27, 1983 and designated as UP-83-6; and WHEREAS, the use permits noted above expired on June 30, 1987, and Earl J. Cook, Sr. has made application pursuant to §40-69 (b) of the Code of the City of Portsmouth, Virginia, 1973 for the' granting of a use permit as hereinafter-described for bott parcels of land noted above; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has made a recommendation regarding the granting of said use permit.
