(1) That the use for whiCh the~use permit <br />hereinafter~descrfbed is sought:~ ~ ~. ~ ~'. ~ ~ ~ ~ <br /> <br /> (a) Will not adversely affect the health and safety <br />of persons residing 0r WOrking in the neighborhood of the <br />proposed use; ~ <br /> <br /> (b) Will not be detrimental to the public use.or <br />injurious to the property or improvemenfs oil the neighborhood;~ <br /> <br /> (c) Will be in accdrd~nce with the purposes of the. <br />Zoning Chapter of the City Code. <br /> <br /> (2) Earl J. Cook, Sr. is hereby granted a use permit <br />pursuant to ~40-69 (b) of the'Code:of 'the City of~PortsmOuth, <br />Virginia to operate a junkyard~at the two parcelS'~more <br />particularly described below~ such.:pard~ls Containihg~' <br />approximately .96 acres: ' <br /> <br /> 705-707 Yorktown Avenue being more particularly described <br />as Tax Map 113, Parcels 34, 35, 36, 62 and 62.1. <br /> <br /> 703-705 Jamestown Avenue being more particularly described <br />as Tax Map 169, Parcels 81, 82 and 83~ ~ ~ <br /> <br /> (2) This use permit is approved subject to the following <br />Conditions: <br /> <br /> (a) That automobiles may not be sheared or crushed <br /> <br />at the location. <br /> <br /> (b) That automobile skeletons Shall not be <br />permanently stored on the property. <br /> <br /> (c) That all junk automobiles awaiting dismantling <br />and aUtOmobile Skeletons awaiting removaI andlall other junk or <br />automobile parts being stored on the premises shall be stored <br />within the fence compound and that no temporary storage outside <br />the fence of the compound areawill be permitted. <br /> <br /> (d) A six (6) foot high fence meeting the : <br />requirements of §40-69: (b) of the Code must be erected alOng~ ~ <br />Jamestown Avenue and be maintained in accordance with the <br />requirements thereof, and a six (6) foo~t high chain link fence <br />be maintained around the balance of the premises. <br /> <br /> (e) Five (5) off-street Parking spaces must be <br />provided. <br /> <br /> (f) This use permit Shall become effective on May <br />31, 1989 if conditions (d) and (e) noted herein have been~ <br />complied with." <br /> <br /> 89-49 <br /> (c) "AN ORDINANCE TO AMEND THE CODE OF THE CITY'OF~ <br />PORTSMOUTH, VIRGINIA, 1973, BY AMENDING SECTIONS 40-31, 40-68 <br />(b) AND 40~71 (b) THEREOF, PERTAINING TO FLEA MARKETS AND <br />SIMILAR USES." <br /> <br /> 88-489 "AN ORDINANCE TO APPROPRIATE $100,000.
