396 <br /> <br />March 28, 1989 <br /> <br /> Councilman Hawks abstained from voting on the item because <br />he has previously represented Garcia-Gelardi Development <br />Corporation in legalmatters. <br /> <br /> On ~otion of Mr. Simpson and.seconded by Mr.. Barnesi the~ <br />following resolution w. as adopted on final reading, and by,the <br />following vote: <br /> <br />"A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING <br />PROJECT PURSUANT TO SECTION 40-55 OF THE CODE OF THE CITY <br />OF PORTSMOUTNr VIRGINIA, 1973, AS AMENDEDi SAID PROJECT <br />BEING LOCATED ON 6.25 'ACRES OF PROPERTY ON THE FORMER <br />BEASLEY~FARMS~TE AND:CONSISTING OF SEVENTY-SIX~ <br />CONDOMINtUM-~NITS AND DESIGN~TE~ AS GHP-8~=i. <br /> <br /> WHEREAS,' Garcia-Gelardi Development Corporation has made <br />application pursuant to §40-55 of the Code of the City of <br />Portsmouth, Virginia, 1973, as amended~ for the granting and <br />approval of a group.housing pro3ect consisting of seventy-six <br />(76) condominium units within nineteen (19) two [2) story <br />buildings on. Parcel 3B of the Rive~Pointe Subdivision,~ such <br />parcel being~approximately 6.25.acresi on the south side of <br />River Pointe Drive, such parcel being a part of the former <br />Beasley Farm and designated as GNP-89-1, such parcel being a <br />portion of Parcel 3'in Zohing Amendment Ordinance Z-85-21, as <br />amended; and <br /> <br /> WHEREAS, the applicant has been determined by the Planning <br />Commission to have met the requirements of ~40-55 of the Code <br />of the City of Portsmouth, Virginia, 1973, as amended; ~and <br /> <br /> WHEREAS, the Planning Commission'has reviewed such <br />application and site plan submitted therewith and has <br />recommended conditional approval of said application; and <br /> <br /> WHEREAS, the developer has amended the application and <br />site plan submitted and has requested approval of an amended <br />project from the City Council; and <br /> <br /> '~HEREAS, the developer has been informed that approval of <br />the group housing project pursuant to ~40-55 grants only an <br />exemption from certain requirements for residencies stated in <br />said section and does not constitute a waiver of any other <br />requirement emDodied in the Subdivision Ordinance, Zoning <br />Ordinance, Code of the City of Portsmouth, Virginia, or any <br />other applicable local, state or federal law or regulation; and <br /> <br /> WHEREAS, the developer is aware that building permits or <br />any other required permit will be issued only upon'compliance <br />with the ordinances, laws or regulations applicable thereto. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia that the certain grouD housing project <br />designated as GHP-89-1, as revised, and being more specifically <br />described and shown on revised plans designated "Wessex Place <br />At River Pointe by Garcia-Gelardi Development Corporation" <br />prepared by Talbot and Associates, Ltd., revised as of March 8, <br />1989, and additional documentation furnished on behalf of the <br />developer, all on file with the~Planning Department of the City <br />of Portsmouth, Virginia, such plans and documentation being <br />made a part hereof, is hereby granted approval subject-to the <br />following terms and conditions: <br /> <br /> (1) Drainage outfalls shall utilize sediment traps or <br />other approgriate measures to filter run-off and shall not <br />extend into any wetlands. <br /> <br /> <br />
