395 March 28, 1989 2. The New Community Church of God In Christ is hereby granted a use permit pursuant to ~40-75 (b) of the Code of the City of Portsmouth, Virginia, 1973, to operate a child daycare center at 3615 Tyre Neck Road, said property b6ing further described as Tax Map 825, Parcels 63 and 64, the activity to be conducted in a newly constructed addition to ~he New Community Church Of God In Christ at said location. 3. The use permit is approved subject to the following conditions: (a) The child daycare center may be operated with an enrollment of not more than twenty (20) children~to be cared for at the facility at any one time. Only children two and one-half (2-1/2) years of age and over may be cared for at the facility. (b) The outdoor play area must be a minimum of 4000 square fee~ and enclosed by a five (5) foot high wood privacy fence. The play area must be improved with fill dirt and grass and dumpsters may not be permitted within the play area and where located must be screened from public view. The play area must be in compliance with the requirements contain6d-herein and approved by the Planning Department prior to the issuance of a Certificate of Occupancy. (c) A total of forty-four (44) off-street parking spaces shall be maintained for the church and the daycare center. (d) Two ¢2) off-street parking spaces in front of the church must be reserved for drop-off of children during the hours of operation of the child daycare center. (e) Ail outdoor activities shall be conducted within the hours of 8:00 ao m. and 6:00 p. m.. (f) Ail indoor activities shall be conducted within the hours of 6:00 a. m. and 6:00 p. m.. (g) A Certificate of Occupancy for the new-addition_musf be obtained and screening of the parking lot across the street in accordance with the applicable provisions of the City Code must be erected and approved by the Planning Department prior to the commencement of the operation of the child daycare center.
