Mark Geduldig-Yatrofsky, 2713 Sterling Point Drive, spoke in opposition to this item. <br /> <br />'" Mr. Moody asked for consensus of City Council to have Staff draft a resolution <br />asking the Southeastern Public Service Authority (SPSA) Board to consider making <br />the fees commercial haulers are paying and the fees citizens are paying more <br />equitable. <br /> <br />Motion by Mr. Whitehurst, and seconded by Ms. Randall, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />"ORDINANCE APPROPRIATING $850,000 IN THE FY 2009-2010 GENERAL FUND <br />IN FUNDS RECEIVED IN A SETTLEMENT WITH THE SOUTHEASTERN PUBLIC <br />SERVICE AUTHORITY FOR UNPAID PAYMENTS IN LIEU OF TAXES." <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />10 - 286 - Adoption of a resolution authorizing the City Manager to execute a Marine <br />Safety and Security Zones Memorandum of Agreement between the City of <br />Portsmouth and the U.S. Coast Guard. Vision Principle: Bold New Directions. <br /> <br />Background: <br />. For the last three (3)+ years, the Portsmouth Police Department as well as other <br />law enforcement agencies throughout the Hampton Roads Port region have entered <br />into Maritime Safety and Security Zone Law Enforcement Memorandums of Agreement <br />arrangements with the US Coast Guard to authorize inter-jurisdictional assistance, <br />cooperation and enforcement action specifically in the port domain. The proposed <br />agreement merely renews prior agreements due to expiration of previous iteration(s). <br /> <br />Purpose: <br />. The purpose of this agreement is to set forth the framework and procedures by <br />which the United States Coast Guard (USCG) through the Captain of the Port (COTP) <br />Hampton Roads, will work together with the City of Portsmouth, under the supervision of <br />the Chief of Police, to enhance the safety and security of waters within their respective <br />jurisdictions, through the cooperative enforcement of maritime safety and security zones <br />that are created by the Coast Guard under the authority of the Magnusson Act, as <br />codified at 50 U.S.C.S 191. <br /> <br />Financial Impact: <br />. No material financial impact. <br /> <br />Recommended Action: <br />. Adoption of the resolution IS recommended.
