May 25. 2010

Financial Impact:
. No local match funding is required.

Recommended Action:
. Adoption of an ordinance. Vision Principle: Thriving Neighborhoods and a Sense
of Community.

Next Steps Following Council Action:
. If the requested appropriation is approved, the Director of DBHS will ensure
funds are properly dispersed and are used to fund up to $750 of the cost to obtain
guardianship for each individual.

Motion by Ms. Randall, and seconded by Mr. Smith, to adopt the following
ordinance, and was adopted by the following vote:

"ORDINANCE APPROPRIATING $750 IN THE FY 2009-2010 BEHAVIORAL
HEAL THCARE SERVICES FUND IN MONIES ALLOCATED BY THE VIRGINIA
DEPARTMENT OF BEHAVIORAL HEALTH AND DEVELOPMENTAL SERVICES TO
THE PORTSMOUTH DEPARTMENT OF BEHAVIORAL HEAL THCARE SERVICES
TO FUND A PORTION OF THE GUARDIANSHIP COSTS FOR AN INDIVIDUAL
WITH A DIAGNOSIS OF INTELLECTUAL DISABILITY."

Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley
Nays: None

10 - 257 - Adoption of an ordinance to amend Section 12-278 of the Code of the City
of Portsmouth, Virginia (2006) pertaining to the authority of the purchasing
administrator to negotiate for professional services. Vision Principle: Bold New
Directions.

Background:
. The current city code requires competitive negotiations for professional services
(architecUengineer contracts) when the cost is expected to exceed $20,000.
. Section 2.2-4303 of the Code of Virginia allows public bodies to establish
purchasing procedures not requiring competitive negotiation for professional services
when the cost is not expected to exceed $50,000.
. The current city code allows contracting for architecturallengineering (AlE)
services for multiple projects provided the contract term is limited to one year,
renewable for two additional one-year terms; the sum of all projects performed in one
contract term doesn't exceed $1,000,000; and the fee of any single project doesn't
exceed $200,000.
. Section 2.2-4301 of the Code of Virginia allows any locality with a population in
excess of 80,000 to contract for AlE services for multiple projects provided the contract
term is limited to one year, renewable for four additional one-year terms; the sum of all
projects performed in one contract term doesn't exceed $5,000,000; and the fee of any
single project doesn't exceed $1,000,000.

Discussion:
. The city is projected to receive state and federal funds for the design highway
improvement projects, retiming of traffic signals and transportation planning initiatives
that exceed the limits of the current Traffic Engineering Annual Services contract.
. Adopting the contracting limits permissible by state code will allow the city more
flexibility in contracting for AlE services and greatly increase the number and size of the
Task Orders that can be procured under future annual services AlE contracts.

Financial Impact:
. None.

Recommended Action:
. Approve the attached ordinance amending chapter 12. Vision Principle: Bold
New Directions.
