4.9 } June 13, 1989 NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the City Manager be, and hereby is, authorized~to grant an easement to ~firginia Power Company for installation of utilities in Portc-entre, more particularly des.ct lbed as~fotio~s .., ~ All t,hat certain piece or parcel of land shown~ on,~pl~t" of ~ right-of-way agreemen~t of Virg~ini~Po~Ter~C~mpany desighated as Plat No.~ 24-89-8~187, attached hereto~and made a part ~ Ayes: Ba~ne~~, Co~prew, Hawks, Lucas, Simpson, Web~b Nays: None 89-247r~--Lett~r f~om the City Manager recommending adoption of~the fol,lowing: (a) A motion to~ remove the Street Clo,sure from the - table.~ (b) An ordinance closing a portion of Commerce Stree~t and~ a~ ten foot wide alley on t,he north' and south side of Commerce Street. (c) A~-re~o.lution to convey five parcels of land to'the ~ortsmouth ~ort and In,dustriai~Commlsslon "On October 26, 1982, the City Council tabled for further study a requ~st~by the~Industrial Development Authority to close a po'~t~0n~of~Commerce Street and an adjacent ten foot alleyway, pi~A~has~requested that City Council remove the Street Closu~e-'from the table. It should be noted that rail service to this prDperty and the 'nearby Portsmouth ~ort and Industrial COmmiss~ion property has been discontinued and that the proposal is consistent with the City Comp~eh~nsiv~ ~l~n and overall development of the area. A motion is required of City Council to remove this item from th~ table; If Council is in concurrence, an ordinance would be required by Cit~ Council to formally close a portion of Commerce Street and the adjacent ten foot a~ley~a~y. In 1983, the Portsmouth Port and Industrial Commission entered into an agreement ~o convey certain parcels of land in Port Norfolk to e~pre~"s Container Service Incorporated,~subject to a deed of trust on the property. According ~o Mr. Burgess, the deed of trust has now been satisfied. PPIC has requested that the City convey to it the properties in question so'that they may ~n ~tu~n co~v~y the property to e×press Container Service. ~ I, therefore, recommend that City Council approve a motion to remove the Street Closure from the~table, approve~ an ' Ordinance ~o ~clos'e~a Portion of Commerce Street and the.~ adjacent te~ foot alleyway, and a,Resolution to :convey five parcels of land to PPIC." '~ a) On motion of Mr. Simpson and seconded by Mr. Hawks to remove the Street Closure from the table was adopted by unanimous vote. b) On motion of Mrs. Lucas and seconded by Mr. Simpson the following ordinance was adopted on first and final reading and by the following vote:
