WHEREAS, July 25, .1989 the application has been determined by Commission to have met the requirements of Section 40-55 of the Code of the City of Portsmouth, Virginia, 1988, as amended, and the Planning Commission has reviewed such application and site plan submitted therewith and has recommended a conditional approval of said application;~ and WHEREAS, the developer has been informed that approval of group housing project pursuant to Section 40-55 grants only an exemption from certain requirements for residents as stated in said section, and does not constitute a waiver of any other requirement embodied in the subdivision ordinance, zoning ordinance, code of the City of Portsmouth, local, state or federal law or regulations; 531 the Planning a or any other applicabl and WHEREAS, the developer is aware that building permits or any other required permits be issued only upon compliance with the ordinances, laws, or regulations applicable thereto. NOW~ THEREFORE, ~BE ~tT RESOLVED by the~Council of the City of Portsmouth, Virginia, that the certain group housing project described above and designated as GHP-89-4 and most specifically described~by correspondence, from Chartes E. willett, Sr., as on the plan filed with the appropriate officials of the City of Portsmouth, Virginia, such correspondence ~and plans being made a part hereof, is hereby granted approval subject to the following terms and conditions: ~ 1. Any retention walls or other bank stabilization structures must be constructed landward of any ~wetlands as defined in Section 39,23 of the City Code. 2. Drainage must be designed to minimize storm water runoff impacts on the, wetlands. 3. A parking lot with a permeable pavin~ surface must be approved by both the Department of Engineering and the Commission of Architectural Review prior to issuance of building permits. 4. A revised site plan, landscaping plan, and elevations reflecting all conditions of approval must be submitted to the Planning Department for review and approval prior to the issuance of building permits." Joe Grabow, 1038 Cherokee Road, representing Flea Market, spoke requesting that flea markets be allowed to operate while Use Permits are being.~considered and that~the fence requirements be deleted.
