WHEREAS, <br /> <br /> July 25, .1989 <br /> <br />the application has been determined by <br /> <br />Commission to have met the requirements of Section 40-55 of the <br />Code of the City of Portsmouth, Virginia, 1988, as amended, and <br />the Planning Commission has reviewed such application and site <br />plan submitted therewith and has recommended a conditional <br />approval of said application;~ and <br /> <br /> WHEREAS, the developer has been informed that approval of <br />group housing project pursuant to Section 40-55 grants only an <br />exemption from certain requirements for residents as stated in <br />said section, and does not constitute a waiver of any other <br />requirement embodied in the subdivision ordinance, zoning <br />ordinance, code of the City of Portsmouth, <br />local, state or federal law or regulations; <br /> <br /> 531 <br /> <br />the Planning <br /> <br />a <br /> <br />or any other applicabl <br />and <br /> <br /> WHEREAS, the developer is aware that building permits or any <br />other required permits be issued only upon compliance with the <br />ordinances, laws, or regulations applicable thereto. <br /> <br /> NOW~ THEREFORE, ~BE ~tT RESOLVED by the~Council of the City of <br />Portsmouth, Virginia, that the certain group housing project <br />described above and designated as GHP-89-4 and most specifically <br />described~by correspondence, from Chartes E. willett, Sr., as <br />on the plan filed with the appropriate officials of the City of <br />Portsmouth, Virginia, such correspondence ~and plans being made a <br />part hereof, is hereby granted approval subject to the following <br />terms and conditions: ~ <br /> <br />1. Any retention walls or other bank stabilization <br /> structures must be constructed landward of any <br /> ~wetlands as defined in Section 39,23 of the City <br /> Code. <br /> <br />2. Drainage must be designed to minimize storm water <br /> runoff impacts on the, wetlands. <br /> <br />3. A parking lot with a permeable pavin~ surface must be <br /> approved by both the Department of Engineering and <br /> the Commission of Architectural Review prior to <br /> issuance of building permits. <br /> <br />4. A revised site plan, landscaping plan, and <br /> elevations reflecting all conditions of approval <br /> must be submitted to the Planning Department for <br /> review and approval prior to the issuance of building <br /> permits." <br /> <br />Ayes: Barnes, Corprew, Gray, Hawks, Lucas, Simpson, Webb <br />Nays:~ None <br /> <br />OtherlItems Under Unfinished BUsiness: <br /> <br />89-49 <br /> <br />Code Amendment <br /> <br /> (c) Ordinance to amend portions of Chapter 40 of the City <br />Code (the Zoning Ordinance ) pertaining to flea markets, <br />second-hand stores, auction houses and similar businesses. <br />(CA-89-2) <br /> <br /> Jim Wilcox, 3709 Victory Boulevard, representing Flea <br />Markets, spoke in support~'of~ the amendment. <br /> <br /> Joe Grabow, 1038 Cherokee Road, representing Flea Market, <br />spoke requesting that flea markets be allowed to operate while <br />Use Permits are being.~considered and that~the fence requirements <br />be deleted. <br /> <br /> <br />
