530 <br /> <br />July 25~,. 1989 <br /> <br /> WHEREAS, the application has been determined by the <br />Planning Commission to have met the requirements of ~40-55 of <br />the Code of ,the City of Portsmouth, Virginia, 1988, as amended, <br />and the Planning Commission has ~reviewed such application and <br />site plans submitted therewith and has recommended a conditional <br />approval of said application; ~nd ..... <br /> <br /> WHEREAS, the developer has been~nformed that the approval <br />of a group housing project pursuant to I40-55 gr.antS only an <br />exemption from certain requirements for residences as stated in <br />said section and ~does not constitute a waiver of any other <br />requirement embodied in the Subd.ivision Ordinance, ZOningI <br />Ordinance, COde of the City of Portsmouth, Virginia, or any <br />other applicab~le local, state O~fede~at..1.aw or regulation; and <br /> <br /> WHEREAS, the developer is aware that the building permits <br />or any other required permit will be issued only upon compliance <br />with the ordi-nances~..laws and regula, tions applicable t~ereto. <br /> <br /> NOW, THEREFORE~ BE IT RESOLVED by the COuncil of th~ City <br />of Po~tSmo~t.h, virginia, that the certain group housing Project <br />designated as GHP-89-~5 and more specifically desCribed on plans <br />filed with the appropriate officials of the City of Portsmouth, <br />Virginia, Such plans and documentations in support thereof ~eing <br />made a part hereof is hereby granted approval subject to the <br />following.terms and conditions: ~ ~ <br /> <br /> (1) The group housing project shall be limited to a <br />maximum of eighty (80) multi-family residential units° <br /> <br /> (2) A subdivision plat vacating the property line <br />adjacent to Westwinds I must be approved and recorded prior to <br />the issuance of any building permits. <br /> <br /> (3) Approval from the Corps of.Engineers must be obtained <br />prior to the filling of any non-tidal wetlands. <br /> <br /> (4) Construction of the buffer area between the PrOposed <br />group housing multi-family complex and~p~oposed Merrifields <br />Section 9 must be completed prior fifty percent (50%) occupancy <br />of the group housing project. <br /> <br /> (5) A site plan, landscaping plan and elevations <br />reflecting all conditions of approval must be submitted to the <br />Ptanning~Department~or review and approval prior to the <br />issuance-of ~buil~ing permits." <br /> <br /> (d) "ZONING ORDINANCE AMENDMENT Z-89-10" <br /> <br /> (f) "A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING <br />PROJECT PURSUANT TO SECTION 40-55 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA, 1988, CONSISTING OF THREE CONDOMINIU~ <br />UNITS AT 348 HAMILTON AVENUE. <br /> <br /> WHEREAS, Charles E.
