529 <br /> July 25, i989 <br /> <br /> WHEREAS, J. Gregory Dodd, representing Westwinds Associates <br />and Newma~ Associates, has made application pursuant to I40-55 of <br />the Code of the City of Portsmouth, Virginia, 1988, as amended, <br />for the granting and~;approvat of a group housing project <br />consisting of one hundred and thirty-two (132) multi-family <br />residential units on a 14.25 ac.re parcel on the north side of <br />Gateway Drive and such parcel being further described as Parcel 8 <br />of Zoning Amendment Ordinance Z-89-4, such group housing project <br />having been designated as GHP-89-2; and <br /> <br /> WHEREAS, the application has been determined by the Planning <br />Commission. to have ~met the requirements of [40-55 of the Code of <br />the.City, of Portsmouth,~ Virginia, 1988, as amended, and the <br />Planning Commission has reviewed such application and site plan <br />submitted therewith and has recommended a conditional approval of <br />said application; and <br /> <br /> WHEREAS, the developer has been informed that the approval o <br />a group housing project pursuant to [40-55 grants only an <br />exemption from certain requirements for residences as stated in <br />said section and does not cons~itute a waiver of any other <br />requirement embodied in the Subdivision Ordinance, Zoning <br />Ordinance, Code of the City io.f Portsmouth, Virginia, or any Other <br />applicable local, state, or federal law or regulation; and <br /> <br /> ~WHEREAS, the developer is aware that building permits or any <br />other required permit will be issued only upon compliance of the <br />ordinances, laws and regulations applicable thereto. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the CounciI of the City of <br />Portsmouth, Virginia that the e~ertain group hou~sing project <br />consisting of one hundred thirty-two (132) multi-family <br />residential units designated as GHP-89-2 and more specifically <br />described on plans filed with the appropriate officials of the <br />City of Portsmouth, Virginia, such plans and documentations in <br />support thereof being made a part hereof is hereby granted <br />approval subject to the following terms and conditions: <br /> <br /> ~ (1~ iThe group-housing project shall be limited to a maximum <br />of one hundred thirty-two (132) multi-family units. <br /> <br /> (2) Approval from the Corps of Engineers must be obtained <br />prior to the filling of any non-tidal wetlands. <br /> <br /> (3) A site plan, landscaping,plan and elevations reflecting <br />all conditions of approval must be submitted to the Planning <br />Department for review and approval prior to the issuance of <br />building permits."-: <br /> <br /> (c) "A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING <br />PROJECT PURSUANT TO. SECTION 40-55 OF THE CODE OF THE CITY OF <br />PORTSMQUTH, VIRGINIA, 1988, 'SAID PROJECT CONSISTING OF 80 <br />MULTI-FAMILY RESIDENTIAL UNITS ON 5.28 ACRES OF LAND ON THE SOUTH <br />SIDE OF GATEWAY DRIVE AND DESIGNATED AS GHP-89-5. <br /> <br /> WHEREAS, J. Gregory Dodd, on behalf of Westwinds ASsociates <br />and Ne%~man Associates, has made application pursuant to I40-55 of <br />the Code of the City of Portsmouth, Virginia, 1988, as amended, <br />for the granting and. approval of a group housing project <br />consisting of eighty (80)~multi-family residential units on a 5 <br />acre parcel on the south sid~ of Gateway Drive, such parcel <br />further described as Parcel t0 in Zoning Ordinance Amendment <br />Z-89-4¥ such group housing project having been designated as <br />GHP-89-5; and <br /> <br /> <br />
