As recommended by staff, City Council, by consensus, gave direction to proceed <br />with the replacement of the Crawford Parkway bulkhead and required modifications to <br />Crawford Parkway, estimated at an approximate cost of $3,000,000. <br /> <br />Financial Impact: <br />. Funds from the Holiday Inn Site Redevelopment will need to be re-programmed <br />to a later date to coincide with the development of that property. <br /> <br />Recommended Action: <br />. Adoption of an ordinance authorizing the re-programming of $3,075,000 from the <br />Capital Project, Holiday Inn Site Redevelopment (#13009), to a Capital Project for <br />design and construction of improvements related to the replacement of the seawall <br />bulkhead along Crawford Parkway. To obtain the required permits for the proposed work and complete necessary <br />design plans. <br /> <br />1. Mark Geduldig-Yatrofsky, 2713 Sterling Point Drive, spoke in opposition to this <br />item. <br /> <br />Motion by Ms. Psi mas, and seconded by Mr. Whitehurst, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />"ORDINANCE AUTHORIZING THE REPROGRAMMING OF $3,075,000 IN THE FY <br />2009-2010 CAPITAL IMPROVEMENTS FUND FROM PROJECT #13009--HOLlDAY <br />INN SITE REDEVELOPMENT TO A NEW CAPITAL PROJECT FOR THE DESIGN <br />AND CONSTRUCTION OF IMPROVEMENTS RELATED TO THE REPLACEMENT <br />OF THE SEAWALL BULKHEAD ALONG CRAWFORD PARKWAY." <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />10 - 115 - Adoption of an ordinance to amend Chapter 12 of the Code of the City of <br />Portsmouth, Virginia (2006) by amending Section 12-121 and appendix a thereof to <br />permit the assessment of an additional court cost of $3.00 in certain civil, criminal and <br />traffic cases to be applied to the replacement of the City courthouses. <br /> <br />Background: <br />. The 2009 Virginia General Assembly authorized the imposition of an additional <br />court cost not to exceed $3.00 to be used towards the replacement of courthouses. <br />. The cost may be imposed in all district and circuit court criminal matters and in all <br />civil matters having an amount in controversy exceeding $500. <br />. The cost can be assessed once the Virginia Department of General Services <br />certifies that a courthouse fails to meet current safety and security guidelines and the <br />deficiency cannot be remedied through renovation of the courthouse. <br /> <br />Discussion: <br />. The City delayed filing for Virginia Department of General Services certification <br />for the courts complex pending resolution of the litigation initiated by the circuit court <br />judges. <br />. Once the certification is received, the clerks of court may begin to assess and <br />collect the additional $3.00 per qualifying criminal and civil case. <br />. The collected funds will be utilized for the new courts center project in <br />PortCentre. <br /> <br />Financial impact: <br />. No City funds are required. <br />
