Financial Impact: . Funds from the Holiday Inn Site Redevelopment will need to be re-programmed to a later date to coincide with the development of that property. Recommended Action: . Adoption of an ordinance authorizing the re-programming of $3,075,000 from the Capital Project, Holiday Inn Site Redevelopment (#13009), to a Capital Project for design and construction of improvements related to the replacement of the seawall bulkhead along Crawford Parkway. Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley Nays: None 10 - 115 - Adoption of an ordinance to amend Chapter 12 of the Code of the City of Portsmouth, Virginia (2006) by amending Section 12-121 and appendix a thereof to permit the assessment of an additional court cost of $3.00 in certain civil, criminal and traffic cases to be applied to the replacement of the City courthouses. Background: . The 2009 Virginia General Assembly authorized the imposition of an additional court cost not to exceed $3.00 to be used towards the replacement of courthouses. . The cost may be imposed in all district and circuit court criminal matters and in all civil matters having an amount in controversy exceeding $500. . The cost can be assessed once the Virginia Department of General Services certifies that a courthouse fails to meet current safety and security guidelines and the deficiency cannot be remedied through renovation of the courthouse. Discussion: . The City delayed filing for Virginia Department of General Services certification for the courts complex pending resolution of the litigation initiated by the circuit court judges. . Once the certification is received, the clerks of court may begin to assess and collect the additional $3.00 per qualifying criminal and civil case. . The collected funds will be utilized for the new courts center project in PortCentre. Financial impact: . No City funds are required.
