Adoption of an ordinance to approve the appropriation of $2,844,870 to the <br />Department of Public Works Waste Management Fund. The Director of Public Works will ensure the funds are utilized in an appropriate <br />manner. <br /> <br />Motion by Mr. Smith, and seconded by Ms. Psi mas, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />"ORDINANCE APPROPRIATING IN THE FY 2009-2010 WASTE MANAGEMENT <br />FUND THE SUM OF $2,844,870 IN PREVIOUSLY UNAPPROPRIATED REFUSE <br />FEES." <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />10 - 113 - Adoption of an ordinance to amend Chapter 22 of the Code of the City of <br />Portsmouth, Virginia (2006) by amending Sections 22-3 and 22-5, adopting new <br />Sections 22-564.1, and by repealing Section 22-471 through 22-579 pertaining to <br />traffic code violation penalties, and to the authority of the City Manager relative to traffic, <br />one-way streets, and the blocking of intersections and crosswalks. Mark Geduldig-Yatrofsky, 2713 Sterling Point Drive, spoke in opposition to section <br />22-5(a) of the ordinance pertaining to this item. <br /> <br />Motion by Mr. Moody, and seconded by Ms. Randall, to defer consideration of <br />Item 10-113 to the March 23, 2010 City Council meeting, and was adopted by the <br />following vote: <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />10- 114 - Adoption of an ordinance authorizing the reprogramming of $3,075,000 in the <br />FY 2009-2010 Capital Improvements Fund from project #13009--Holiday Inn Site <br />redevelopment to a New Capital Project for the design and construction of <br />improvements related to the replacement of the seawall bulkhead along Crawford <br />Parkway. The impact of the November 2009 Nor'easter served to bring attention to the <br />condition of the seawall bulkhead along Crawford Parkway and reinforce the need to <br />program its replacement as soon as possible. <br />. In a presentation to City Council on November 24, 2009, four potential action <br />items were presented with respect to the flooding in Olde Towne. In order of priority <br />these were the replacement of the Crawford Parkway bulkhead, raising and completion <br />of improvements to Crawford Parkway, installation of a storm water pumping station at <br />the north end of Dinwiddie Street and construction of a storm water bulkhead along <br />Swimming Point. <br />
