<br />At a Regular Meeting of the City Council on Tuesday, March 9, 2010, there were
<br />present:

<br />Mayor James W. Holley III, Vice Mayor William E. Moody, Jr., Charles B. Whitehurst,
<br />Sr., Marlene W. Randall, Stephen E. Heretick, Elizabeth M. Psi mas, Douglas L. Smith,
<br />City Manager Kenneth L. Chandler, Senior Deputy City Attorney George M. Willson.

<br />Reverend Gregory Yancey, Sr., opened the meeting with prayer, which was
<br />followed by the Pledge of Allegiance to the Flag.
<br />
<br />Mayor Holley called the meeting to order and welcomed all in attendance.
<br />
<br />Motion by Mr. Whitehurst, and seconded by Ms. Randall, to approve the minutes
<br />of Called Meetings of February 22, 2010, of a Called Meeting of February 23, 2010, of a
<br />Regular Meeting of February 23, 2010, of a Special Meeting of February 25, 2010, and
<br />of a Called Meeting of February 27,2010, and was adopted by the following vote:

<br />- Public Hearing -
<br />
<br />10 - 81 - Public hearing on a street closure application:
<br />
<br />(a) S-10-01
<br />
<br />SOUTHSIDE - Ordinance granting the request of David L. Nimmich
<br />for the closure of a portion of Portsmouth Boulevard between Third
<br />Street and Port Centre Parkway. The Comprehensive Plan's
<br />Generalized Future Land Use Map recommends Mixed Use
<br />Employment. Deferred from the February 23, 2010 City Council
<br />Meeting. Vision Principle: Bold New Directions.

<br />Motion by Mr. Whitehurst, and seconded by Ms. Randall, to defer consideration
<br />of Item S-10-01 to the March 23, 2010 City Council meeting, and was adopted by the
<br />following vote:

<br />- City Manager's Report -
<br />
<br />10 - 112 - Adoption of an ordinance appropriating in the FY 2009-2010 Waste
<br />Management Fund the sum of $2,844,870 in previously unappropriated refuse fees.
<br />Vision Principle: Thriving Neighborhoods and a Sense of Community.

<br />Background:
<br />. When the FY 2009-2010 budget was adopted on May 12, 2009 the SPSA fee
<br />was $107.00 per ton. After the budget was approved SPSA increased its tipping fee to
<br />$170.00 per ton. Although as of July 1, 2009 the City of Portsmouth set an increased
<br />refuse fee from $32.00 per unit to $40.72 per unit (per Ordinance, Appendix A-Fee
<br />Schedule Chapter 16-64) the FY 2009-2010 budget was not amended to reflect the
<br />additional revenue generated from the rate increase.
<br />. The requested action is a legal "housekeeping" matter.
<br />
<br />Discussion:
<br />. The approved FY 2009-2010 Waste Management Budget is $13,280,850.
<br />. Revenue generated from the increased refuse charge of $40.72/month for
<br />33,000 accounts is $16,125,120 or increased revenues of $2,844,870 for the FY 2009-
<br />2010.
