<br />February 23. 2010 <br /> <br />WHEREAS, the Portsmouth Fallen Heroes Memorial Foundation (the <br />"Foundation") has been created for the purpose of funding, developing, and maintaining <br />such a monument in Portsmouth, and <br /> <br />WHEREAS, it is the intent of the Foundation to raise private funds for the <br />construction and maintenance of a Portsmouth Fallen Heroes Monument of appropriate <br />dignity and stature, <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1. The City hereby determines that it is in the public interest for the Foundation <br />to fund, develop, and maintain such a memorial, and the City commends the <br />Foundation for its efforts toward this end. <br /> <br />2. The City expresses its support in principle for having the monument on public <br />property at an appropriate location. <br /> <br />3. The City Manager and City Attorney are directed to work with the Foundation <br />toward the goals inherent in this resolution, and they shall report to Council from time to <br />time about the status of this matter, including the nature and location of the monument <br />that is to be constructed." <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />10 - 87 - Adoption of a resolution concerning a proposed government ABC Store to be <br />located in close proximity to I.C. Norcom High School. Vision Principle: Pride of Past, <br />Promise of Future. <br /> <br />Background: <br />. The Virginia Department of Alcoholic Beverage Control has tentatively decided to <br />relocate a Government ABC Store from its present location in the London Plaza <br />Shopping Center, close to Effingham Street, to a new location in the Food Lion <br />Shopping Center on Peninsula Street, facing I.C. Norcom High School. <br /> <br />Discussion: <br />. The proposed location is objectionable because it will cause undue exposure of <br />high school students to alcoholic beverages. <br />. The City has no zoning control over facilities of the ABC Department. The <br />location of Government ABC Stores is within the discretion of the ABC Department. <br />. By this resolution, City Council requests the ABC Department to use its discretion <br />more wisely and to choose a more appropriate location for this store. <br /> <br />Financial Impact: <br />. No financial impact. <br /> <br />Recommended Action: <br />. Adoption of the resolution IS recommended. Vision Principle: Pride of Past, <br />Promise of Future. <br /> <br />Next Steps Following Council Action: <br />. City Clerk shall transmit resolution to ABC Department, to Governor McDonnell, <br />and to members of the Portsmouth delegation to the General Assembly. <br />. City Manager or his designee shall work as needed with the ABC Department to <br />select a more appropriate location for the proposed Government ABC Store. <br /> <br />Motion by Mr. Whitehurst, and seconded by Ms. Randall, to adopt the following <br />resolution, and was adopted by the following vote: <br />
