575 <br /> <br /> September 12_, 1989 <br /> <br /> On motion of Mr. SimpSo~ ~d seconded by Mr. Gray, the <br />foll~win.g ordinance was adopted on first and final reading andCby <br />the~fotlowi'ng.vo.te: <br /> <br /> "AN ORDINANCE CLOSING A 16 FOOT ALLEY ON THE EAST SIDE OFi <br />TYRE NECK ROAD BETWEEN FAWKES STREET AND ERIC STREET." <br /> <br /> Ayes: Barnes, Corprew, Gray, Hawks, LucaS, Simpson, Webb <br /> Nays: None <br /> <br />89-367 Letter from the City Manager recommending adoption of a <br />resolution appointing,viewers for clOSing an_alley on the East~! <br />Side of Academy Avenue, <br /> <br /> "Joseph L. Cox has made application to vacate, close and <br />discontinue an alley on the East Side of Academy Avenue. The <br />Notice of Application and. Request for Appointment of Viewers has <br />been advertised. <br /> <br /> I redommend adoption of the resolution appointing viewers <br />this application." <br /> <br /> On motion of Mr. Gray and seconded by Mr. Simpson, the <br />following resolution was adopted on first and final reading, and <br />by the following~vote: <br /> <br /> A RESOLUTION APPOINTING VIEwERs FOR CLOSING AN ALLEY ON THE <br />EAST SIDE OF ACADEMY AVENUE. <br /> <br /> WHEREAS, Joseph L. Cox has made application.to vacate, close <br />and discontinue the hereinafter-described alley on the East Side <br />of Academy Avenue, and it appearing that Notice of Application an( <br />Request for Appointment of Viewers has been advertised as <br />requested by law. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia, that Richard D. Ottavio, Charles Hudgins, <br />Robert Reed, Harrison Miller~and~Moses Gibson~be appointed viewer~ <br />and that Casey Lavender and Roy~!Leinart, be appointed alternate <br />viewers in the event one of the preceding viewers fails to <br />participate, said viewers to view the hereinafter-described <br />portion of such alley and to report to this Council in writing <br />whether in their'opinion any,<and if any what, inconvenience woul. <br />result in vacating and closing the following: <br /> <br /> Ail that certain piece or parcel of land <br />designated as a 16 foot lane and more <br />particularly described as follows: Beginning <br />at a point where the eastern line of Lot 17, <br />Block 29, Churchland Land Company intersects <br />Academy Avenue, thencerunning east a distance <br />~f ~90.15 feet, more or: les~s/ to Tyre~Neck <br />Road, and thence north 16.01 feet, thence <br />running west a distance of 90..15~feet, thence <br />running south a distance of 20.12 feet to <br />the point of Beginning." <br /> <br />Ayes: Barnes, Corprew, Gray, <br />Nays: None <br /> <br />Hawks, Lucas, Simpson, Webb <br /> <br /> <br />
