FROM THE GENERAL <br />FUND FOR THE'~URPOSE OF PROVIDING-FOUR ADDITIONAL CORRECTIONAL <br />OFFICERS FOR THE'PORTSMOUTB SHERIFF'S OFFICE.AS AUTHORIZED BY <br />THE STATE COMPENSATION BOARD." ' - ' ~- <br /> <br />89-365 Letter from the City Manager recommending adoption of <br />an ordinance to appropriate $21,600 from the Cap-ital Improvement <br />Fund for improving drainage on Early Drive-.~ ~ <br /> <br /> "In ~he'summer' of 1987, a stop work order was placed on a <br />property owner in t~e 30 block of-Early Drive who was filling a <br />private ditch located in the rear of his property. When the <br />property owner refused to comply with the City's direction to <br />re-establish the existing drainage patterns, the proper~ty owner <br />was criminal~ly prosecuted. The court however, refused to con- <br />vict the property~own~r. <br /> <br /> City st~ff'has surveyed the property lines and prepared a <br />plat for the affected properties. Additionally, staff developed <br />cost estimates for securing easements as well as re-establishing <br />the open ditch. In an attempt to address some of the property <br />owners concern for an open ditch, a cost proposal was developed <br />for the ditch to be piped (50-50 cost sharing for the cost of <br />piping versus an open ditch). However, our efforts have been <br />unsuccessful in having this proposall agreed upon by the affected <br />property owhers. <br /> <br /> The following ~s the Public Works <br />re-establishin~ 'the open ditch: <br /> <br /> Labor &-Equipment <br /> Contingencies <br /> $21,600 <br /> <br />Director's estimate for <br /> <br /> $12,650 <br /> 8,950 <br /> <br /> An appropriation from the CIP contingency is the~refore <br />requested in the amount of $21,600 as well as permission to <br />secure the necessary easements to proceed with the project." <br /> <br /> The following citizens spoke in opposition to the <br />ordinance: ~ ' <br /> <br /> Thomas R. Broughton, 32 Early Drive, represen:ting, self. <br /> <br /> Marie Broughton, 32 Early Drive, representing self <br />(Exhibit 89-3651). <br /> <br /> On motion of 'Mr. Gray and s. eco~ded by Mrs. Lucas, the item <br />was deferred to the meeting of September 26, 1989 and with <br />notice to be sent to the affected neighbors from the City <br />Manager's Office and was approved by unanimous vote. <br /> <br />89-366 Letter from the City Manager recommending adoption of <br />an ordinance closing a 16 foot alley on the east side of Tyre <br />Neck Road between Fawkes Street-'an~ Eric Street. <br /> "New Community Church of God in! Christ has made <br />application to~clcse ~a 16 foot alley'On ~h~ East side of Tyre <br />Neck Road b~twee-n'Fawkes Street'~and' Eric ~tr~et. <br /> <br /> The viewers previously appointed by Council have <br />recommended approval of the application. The Planning <br />Commission concurs in this recommendation. ' : <br /> <br /> I recommend adoption of the ordinance closing the 16 foot <br />alley as requested by the applicant." <br /> <br /> <br />
