574 September ~2, 1989 On motion of Mr. Gray and seconded by Mr. Simpson, following ordinance was approved on first reading and by unanimous vote: the "AN ORDINANCE TO APPROPRIATE $76,432. FROM THE GENERAL FUND FOR THE'~URPOSE OF PROVIDING-FOUR ADDITIONAL CORRECTIONAL OFFICERS FOR THE'PORTSMOUTB SHERIFF'S OFFICE.AS AUTHORIZED BY THE STATE COMPENSATION BOARD." ' - ' ~- 89-365 Letter from the City Manager recommending adoption of an ordinance to appropriate $21,600 from the Cap-ital Improvement Fund for improving drainage on Early Drive-.~ ~ "In ~he'summer' of 1987, a stop work order was placed on a property owner in t~e 30 block of-Early Drive who was filling a private ditch located in the rear of his property. When the property owner refused to comply with the City's direction to re-establish the existing drainage patterns, the proper~ty owner was criminal~ly prosecuted. The court however, refused to con- vict the property~own~r. City st~ff'has surveyed the property lines and prepared a plat for the affected properties. Additionally, staff developed cost estimates for securing easements as well as re-establishing the open ditch. In an attempt to address some of the property owners concern for an open ditch, a cost proposal was developed for the ditch to be piped (50-50 cost sharing for the cost of piping versus an open ditch). However, our efforts have been unsuccessful in having this proposall agreed upon by the affected property owhers. The following ~s the Public Works re-establishin~ 'the open ditch: Labor &-Equipment Contingencies $21,600 Director's estimate for $12,650 8,950 An appropriation from the CIP contingency is the~refore requested in the amount of $21,600 as well as permission to secure the necessary easements to proceed with the project." On motion of 'Mr. Gray and s. eco~ded by Mrs. Lucas, the item was deferred to the meeting of September 26, 1989 and with notice to be sent to the affected neighbors from the City Manager's Office and was approved by unanimous vote. 89-366 Letter from the City Manager recommending adoption of an ordinance closing a 16 foot alley on the east side of Tyre Neck Road between Fawkes Street-'an~ Eric Street. "New Community Church of God in! Christ has made application to~clcse ~a 16 foot alley'On ~h~ East side of Tyre Neck Road b~twee-n'Fawkes Street'~and' Eric ~tr~et. The viewers previously appointed by Council have recommended approval of the application. The Planning Commission concurs in this recommendation. ' : I recommend adoption of the ordinance closing the 16 foot alley as requested by the applicant."
