Mark Geduldig-Yatrofsky, 2713 Sterling Point Drive, spoke in support of this item but had objection to the City Code Section 2-658 which allows the Director of Emergency Services the ability to take possession of private property in an emergency situation. Motion by Mr. Heretick, and seconded by Mr. Smith, to adopt the following resolution, and was adopted by the following vote: "RESOLUTION CONFIRMING A DECLARATION OF EMERGENCY MADE BY THE CITY MANAGER ON NOVEMBER 12, 2009 IN CONNECTION WITH AN EXTREME WEATHER CONDITION. BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the Declaration of Local Emergency made by City Manager Kenneth L. Chandler on November 12, 2009, for the extreme weather condition commonly known as "The November Nor'easter," a copy of which is attached hereto, is hereby confirmed, pursuant to Sec. 2-658 of the Code of the City of Portsmouth, Virginia (2006)."
