<br />September 22. 2009 <br /> <br />Next Steps Following Council Action: <br />. Appointment of the proposed members of the municipal finance committee by <br />City Council. <br /> <br />Motion by Mr. Whitehurst, and seconded by Ms. Psimas, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />"ORDINANCE TO REPEAL SECTIONS 12-141 THROUGH 12-151 OF THE CODE OF <br />THE CITY OF PORTSMOUTH, VIRGINIA (2006) PERTAINING TO THE <br />ESTABLISHMENT AND DUTIES OF THE MUNICIPAL FINANCE COMMISSION." <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst <br />Nays: Holley <br /> <br />09 - 421 - Adoption of an ordinance to amend Chapter 23 of the Code of the City of <br />Portsmouth, Virginia (2006) by establishing a New Article VI to be entitled <br />"Miscellaneous Nuisances" and adopting a new Section 23-106 pertaining to removal or <br />repair of defaced buildings. Deferred from the August 11, 2009 City Council Meeting. <br />Vision Principle: Thriving Neighborhoods and a Sense of Community. <br /> <br />Motion by Ms. Psi mas, and seconded by Mr. Smith, to accept staff's withdrawal <br />of item 09-421, and was adopted by the following vote: <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />- City Manager's Report - <br /> <br />09 - 490 - Adoption of an ordinance appropriating $319 in the FY 2009-2010 Law <br />Library Fund. Vision Principle: Thriving Neighborhoods and a Sense of Community. <br /> <br />Background: <br />. The Portsmouth Circuit Court judges have received a settlement check for $319 <br />in a Washington state class action suit (Global Education Services, Inc. v. The <br />Grantsmanship Center, Inc.) <br />. The suit stemmed from seminar promotion representations made by The <br />Grantsmanship Center. <br />. The judges were not parties to the action. <br />. The judges have requested that the settlement funds be allocated to the <br />Portsmouth Law Library. <br /> <br />Discussion: <br />. After the completion of the budget process, unbudgeted funds received are <br />normally placed in the General Fund as undesignated funds. <br />. In order to comply with the judges' request, these funds must be appropriated in <br />Law Library Fund. <br /> <br />Financial Impact: <br />. Budgeted funds in the FY 2009-2010 Law Library Fund will increase by $319. <br /> <br />Staff Recommends: <br />. Adoption of the ordinance appropriating the funds in the FY 2009-2010 Law <br />Library Fund, as requested.
