September 22. 2009 Next Steps Following Council Action: . Appointment of the proposed members of the municipal finance committee by City Council. Motion by Mr. Whitehurst, and seconded by Ms. Psimas, to adopt the following ordinance, and was adopted by the following vote: "ORDINANCE TO REPEAL SECTIONS 12-141 THROUGH 12-151 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA (2006) PERTAINING TO THE ESTABLISHMENT AND DUTIES OF THE MUNICIPAL FINANCE COMMISSION." Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst Nays: Holley 09 - 421 - Adoption of an ordinance to amend Chapter 23 of the Code of the City of Portsmouth, Virginia (2006) by establishing a New Article VI to be entitled "Miscellaneous Nuisances" and adopting a new Section 23-106 pertaining to removal or repair of defaced buildings. Motion by Ms. Psi mas, and seconded by Mr. Smith, to accept staff's withdrawal of item 09-421, and was adopted by the following vote: Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley Nays: None - City Manager's Report - 09 - 490 - Adoption of an ordinance appropriating $319 in the FY 2009-2010 Law Library Fund. The Portsmouth Circuit Court judges have received a settlement check for $319 in a Washington state class action suit (Global Education Services, Inc. v. The Grantsmanship Center, Inc.) . The suit stemmed from seminar promotion representations made by The Grantsmanship Center. . The judges were not parties to the action. . The judges have requested that the settlement funds be allocated to the Portsmouth Law Library. Discussion: . After the completion of the budget process, unbudgeted funds received are normally placed in the General Fund as undesignated funds. . In order to comply with the judges' request, these funds must be appropriated in Law Library Fund. Financial Impact: . Budgeted funds in the FY 2009-2010 Law Library Fund will increase by $319.
