That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) The occupant load of the facility shall not exceed 75 persons, including staff and <br />patrons, at any time as required by the Building Official. <br /> <br />(b) The hours of operation shall be no earlier than 8:00 a.m. to no later than 10:00 <br />p.m. <br /> <br />(c) The required eighteen (18) parking spaces for the business shall be provided for <br />in the shared parking area of the shopping center. <br /> <br />(d) The applicant shall obtain and retain all appropriate permits and licenses for the <br />establ ishment. <br /> <br />(e) The proposed business shall operate in accordance with federal, state and local <br />regulations. <br /> <br />(f) The applicant shall be required to install a backflow preventer, if determined <br />necessary by the Department of Public Utilities. <br /> <br />(g) All taxes in connection with the proposed use shall be paid when due. <br /> <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council." <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />09 - 461 - Adoption of an ordinance to repeal Sections 12-141 through 12-151 of the <br />Code of the City of Portsmouth, Virginia (2006) pertaining to the establishment and <br />duties of the Municipal Finance Commission. Deferred from the September 8, 2009 <br />City Council Meeting. Vision Principle: A Robust and Prospering Economy. <br /> <br />Background: <br />. At the August 25th City Council public work session, City Council determined that <br />the current municipal finance commission, as established, no longer meets the City's <br />ongoing financial planning needs. <br />. It is City Council's intent to address those needs in the future through the <br />establishment of a committee composed of city council members, city staff, and others. <br /> <br />Discussion: <br />. In order to proceed with its plan, Council first needs to repeal the city code <br />sections 12-141 through 12-151 that require the establishment of a municipal finance <br />commission. <br /> <br />Financial Impact: <br />. Repeal of these code sections will involve no financial expenditures. <br /> <br />Staff Recommends: <br />. Repeal of City Code Sections 12-141 through 12-151.
