September 22. 2009 UP-09-10 Churchland Shopping Center Unit 19 Tax Map 808, Parcel 1 3. That the use permit is approved subject to the following conditions which shall be observed by the applicant and any successor in interest: (a) The occupant load of the facility shall not exceed 75 persons, including staff and patrons, at any time as required by the Building Official. (b) The hours of operation shall be no earlier than 8:00 a.m. to no later than 10:00 p.m. (c) The required eighteen (18) parking spaces for the business shall be provided for in the shared parking area of the shopping center. (d) The applicant shall obtain and retain all appropriate permits and licenses for the establ ishment. (e) The proposed business shall operate in accordance with federal, state and local regulations. (f) The applicant shall be required to install a backflow preventer, if determined necessary by the Department of Public Utilities. (g) All taxes in connection with the proposed use shall be paid when due. 4. REVOCATION OF PERMIT: Violation of any of the above conditions may serve as grounds for revocation of the use permit by the City Council." At the August 25th City Council public work session, City Council determined that the current municipal finance commission, as established, no longer meets the City's ongoing financial planning needs. . It is City Council's intent to address those needs in the future through the establishment of a committee composed of city council members, city staff, and others. Discussion: . In order to proceed with its plan, Council first needs to repeal the city code sections 12-141 through 12-151 that require the establishment of a municipal finance commission. Financial Impact: .
