<br />AUQust 25. 2009 <br /> <br />(j) Taxes and fees associated with the applicant's property shall be paid when due. <br /> <br />(k) In the event that the tower is unused or becomes obsolete, it must be removed <br />within twelve months from the date that use ceases. <br /> <br />(I) Applicant and any subsequent tower operator shall maintain insurance with <br />respect to its development and use of the property for the proposed wireless <br />communications tower, as required by its agreements with the property owner and <br />Dominion Power. <br /> <br />(m) Lighting for the tower compound will be directed in such a way as not to impact <br />neighboring residents' quality of life. <br /> <br />(n) The noise and odor produced by the site shall not adversely impact neighboring <br />property owners. <br /> <br />(0) Only one tower shall be built on the site known as 3797 Lilac Drive under this use <br />permit. No antennas other than those of the applicant shall be installed on the tower. <br /> <br />(p) After construction is complete, except in an emergency or because of equipment <br />failure, access to the equipment by applicant will be limited to once every six months. <br /> <br />(q) After construction is complete, access to the applicant's equipment by applicant <br />will be through shared use of the existing driveway, as depicted on the site plan. <br /> <br />4. Vision Principle: Thriving <br />Neighborhoods and a Sense of Community and Bold New Directions. <br /> <br />Background: <br />. The Portsmouth Police Department has received grant funding of $654,981from <br />the Department of Justice - Bureau of Justice Assistance to provide funds for <br />technology and equipment. <br /> <br />Discussion: <br />. The American Recovery and Re-investment Act- JAG 2009 grant will be used to <br />provide funding for technology and equipment initiatives that will improve the <br />department's ability to respond to public safety incidents within the City. <br /> <br />Financial Impact: <br />. The grant award amount is $654,981.00 of Department of Justice funds for the <br />Portsmouth Police Department. The City does not have to provide any match monies <br />and there is no obligation from the City once the grant has ended. <br /> <br />Staff Recommends: <br />. Adoption of an ordinance to appropriate the $654,981 from the Department of <br />Justice grant to provide funds for technology and equipment for the Portsmouth Police <br />Department.
