<br />AUQust 25. 2009 <br /> <br />(b) Will not be detrimental to the public use or InJurious to the property or <br />improvements in the neighborhood; <br /> <br />(c) Will be provided with sufficient landscaping to Insure compatibility with <br />surrounding uses; <br /> <br />(d) Will be a project that will be developed according to a plan for parking, <br />driveways, and curb cuts which will provide for safe and convenient traffic movement; <br />and <br /> <br />(e) Will be In accordance with the purposes of the City of Portsmouth Zoning <br />Ordinance. <br /> <br />2. That the application of T-Mobile Northeast, LLC, for a use permit) to <br />construct and operate a telecommunications facility at 5788 Churchland Boulevard is <br />hereby granted, and the subject property is more particularly described as follows: <br /> <br />UP-09-04 <br /> <br />3797 Lilac Drive <br /> <br />Map 852, Parcel 84 <br /> <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) The tower shall not exceed 128 feet in height, including antennas. <br /> <br />(b) The tower shall be constructed in substantial compliance with the site plan <br />entitled "T-Mobile Northeast, LLC. Site Name: VEPCO #226/213 Hutson, Site Number <br />VA50552B, Site Address, 3797 Lilac Drive, Portsmouth, VA 23703" prepared by AIIPro <br />Consulting Group, Inc., last revised July 30, 2009, and on file in the Office of Planning. <br /> <br />(c) The tower shall be enclosed in wooden board on board fence that is a maximum <br />of seven feet in height. The fencing shall not contain barb or razor wire. A Landscaping <br />plan screening the fence area must be submitted to the Planning Director for review and <br />approval. <br /> <br />(d) The project must be formally reviewed through the Site Plan Review Process. <br /> <br />(e) Advertising and signs shall not be attached to the tower. Towers not subject to <br />federal requirements will have a gray galvanized or other appropriate finish. Towers <br />subject to federal regulations shall be painted and/or lit only in accordance with FCC <br />and FAA requirements. <br /> <br />(f) Prior to the issuance of a building permit, the applicant shall submit plans to the <br />City Building Official, certified by a qualified professional engineer that the tower will <br />meet all requirements of the Statewide Building Code. <br /> <br />(g) The applicant shall comply with the submitted Radio Frequency (RF) Emissions <br />Report of which details the proposed levels of nonelectromagnetic radiation emitted <br />from the proposed tower and ensures that the radiation levels will not exceed ground <br />level exposure standards established by the Federal Communications Commission <br />(FCC) and other U. S. Government Agencies. <br /> <br />(h) The applicant shall be responsible for resolving any interference the facility <br />causes to any equipment such as radios, televisions, cellular phones, computers, etc. <br />operated by users within the area. <br /> <br />(i) The tower shall be operated in compliance with all applicable codes, ordinances, <br />and regulations of federal, state and local governments. <br />
